Section 1. Recitals: The foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and are made a specific part of this Ordinance. Section 2. Amendments to the Comprehensive Plan: The Plan Amendments, attached as Exhibit "A", adding the Public School Facilities Element, and amending the Capital Improvement Element and the Intergovernmental Coordination Element of the City's Comprehensive Plan in order to implement public Sd100l concurrency, is hereby approved. Section 3. Transmittal: The City's Consultant, Bell David Planning Group is hereby directed to transmit the City of Sunny Isles Beach Public Facilities Plan Amendments to the State Department of Community Affairs in accordance with Florida Statute 163.3191. Section 4. Severability. If any section, subsection, clause or provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected by such invalidity. Section 5. Repeal of Conflicting Provisions. All ordinances, or parts of ordinances in conflict herewith be, and the same, are hereby repealed Section 6. Inclusion In The Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 7. Effective Date. This Ordinance shall become effective ten (10) days after adoption on second reading. PASSED and ADOPTED on First Reading the ~day of J')e("~mb'E!.V", 2007.
