<br />LP A RESOLUTION NO. 2008 - .5L <br /> <br />A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, RECOMMENDING TO THE <br />CITY COMMISSION OF SUNNY ISLES BEACH, THE ORDINANCE <br />AMENDING THE CITY'S ADOPTED COMPREHENSIVE PLAN BY <br />ADDING A PUBLIC SCHOOL FACILITIES ELEMENT AND <br />AMENDING THE CAPITAL COORDINATION ELEMENT AND THE <br />INTERGOVERNMENTAL COORDINATION ELEMENT, ATTACHED <br />HERETO AS EXHIBIT "A", AND THE REQUIRED TRANSMITTAL TO <br />THE STATE DEPARTMENT OF COMMUNITY AFFAIRS PURSUANT <br />TO CHAPTER 163.3191 OF THE FLORIDA STATUTES; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach, Florida was incorporated on June 17, 1997; <br /> <br />and <br /> <br />WHEREAS, pursuant to the provisions of the Local Government Comprehensive Planning <br />and Land Development Regulation Act, on October 5, 2000, the City of Sunny Isles Beach <br />adopted its Comprehensive Plan; and <br /> <br />WHEREAS, the Department of Community Affairs has found the Sunny Isles Beach <br />Comprehensive Plan in compliance with the Local Government Comprehensive Planning and <br />Land Development Regulations Act; and <br /> <br />WHEREAS, Chapter 163, Sections 163.3184 and 163.3187, Florida Statutes, provides <br />procedures for amendments to adopted local comprehensive plans; and <br /> <br />WHEREAS, Section 265-8 of the City of Sunny Isles Beach Land Development Code <br />provides for amendments to the City's Comprehensive Plan; and <br /> <br />WHEREAS, the City of Sunny Isles Beach proposed an amendment adding a Public <br />School Facilities Element and amending the Capital Improvement Element and the <br />Intergovernmental Coordination Element of the City of Sunny Isles Beach Comprehensive Plan; <br />and <br /> <br />WHEREAS, the City Commission serves as the Local Planning Agency ("LP A"), and <br />whereas the LPA is required to review amendments to the City's Comprehensive Plan; and <br /> <br />WHEREAS, on December 13, 2007, the City Commission, acting in its capacity as the <br />City's Local Planning Agency, reviewed the proposed amendment, held an advertised public <br />hearing, provided for participation by the public in the process; and <br /> <br />WHEREAS, the LP A has determined that it is in the best interest of the City and its <br />residents to recommend approval of the proposed inclusion of the Public School Facilities Element, <br />and amendments to the Capital Improvement Element and the Intergovernmental Coordination <br /> <br />LPA R2008, Transmittal ofComp Plan Education Facilities to DCA <br />
