RESOLUTION NO.99- \ (D <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ACCEPTING THE FINAL REPLAT <br />OF LOTS 4, 5, 6 & 7 OF BLOCK 1, SUNNY ISLES SHORES SECTION A, <br />PLAT BOOK 53 AT PAGE 95, LYING IN SECTION 11, TOWNSHIP 52 <br />SOUTH, RANGE 42 EAST, LOCATED AT NORTH BAY ROAD, <br />BETWEEN 180 DRIVE AND 182ND DRIVE; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, Marina Bay Club, Inc., a Florida corporation, has secured a tentative plat of <br />the Marina Bay Club in order to vacate certain easements to allow the property owner to utilize <br />its property; and <br />WHEREAS, Lauris Boulanger, president of Marina Bay Club, Inc., now presents to this <br />Commission in accordance with Section 28-8 of the Code of Miami -Dade County and Section <br />177.071, F.S. (1977) a final replat of certain lands lying in the City of Sunny Isles Beach, said <br />plat to be known as the Marina Bay Club, the same being a replat of lots 4, 5, 6 & 7 of Block 1, <br />Sunny Isles Shores, Section A, as recorded in Plat Book 53, at Page 95 of the Public Records of <br />Miami -Dade County, Florida, located between 180'h Drive and 182nd Drive west of North Bay <br />Road; and <br />WHEREAS, it appears that all requirements of the law concerning said plat insofar as <br />the authority of this Commission is concerned, have been complied with; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: <br />Section 1. Final Plat Approved. This final replat is hereby approved. A dedication of <br />streets, alleys and other rights of way however designated or depicted on said plat is hereby <br />accepted; that any easements to be vacated are hereby so vacated; that plat restrictions as may be <br />listed on the plat are approved and are to be enforced; that the approval of the plat is not a waiver <br />of any zoning regulations and that this approval is conditioned upon proper execution of all <br />documents required by the City Attorney's office. <br />Section 2. Effective Date.
