RESOLUTION NO.99-173 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, WAIVING CERTAIN POTENTIAL <br />CONFLICTS OF INTEREST IN CONNECTION WITH THE <br />ENGAGEMENT BY THE CITY MANAGER OF THE FIRM OF <br />GREENBERG TRAURIG TO RENDER A TAX OPINION WITH <br />RESPECT TO ORDINANCE NO. 99- FOR THE ISSUANCE OF TAX <br />REVENUE CERTIFICATES; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City Commission approved Ordinance No. 99- , allowing for a <br />loan; and <br />WHEREAS, in order to complete the documentation for the loan, a tax opinion with <br />respect to that loan, the City Manager has engaged the firm of Greenberg Traurig; and <br />WHEREAS, Greenberg Traurig has occasionally appeared before this Commission on <br />behalf of other clients whom may now or in the future have interests adverse to that of the City; <br />and <br />WHEREAS, while there may be no actual conflict of interest, it is necessary and <br />desirable and the Rules of Professional Conduct regulating the Florida Bar allow for it, if it is <br />deemed to be in the best interest of the City to waive any potential conflict of interest ; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Waiver of Conflict of Interest. The City hereby waives any conflict of interest <br />that Greenberg Traurig may have now, or in the future, as a result of its representation of the City <br />with respect to documentation and issuance of an opinion with respect to Ordinance No. 99- <br />Section 2. Effective Date.
