<br />RESOLUTION NO. 99- \ ~L.{. <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING <br />AN AGREEMENT RELATING TO FLORIDA CABLE <br />TELEVISION ORDINANCE NO. 99-~ AND GRANTING <br />TO RIFKIN/NARRAGANSETT SOUTH FLORIDA CATV, <br />LTD., AND INTERLINK COMMUNICATIONS PARTNERS, <br />LLLP, ITS SUCCESSORS AND/OR ASSIGNS, D/B/A <br />"CABLEVISION," A FRANCHISE TO OWN, OPERATE AND <br />MAINTAIN CABLE TELEVISION SYSTEM IN THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA; SETTING FORTH <br />CONDITIONS ACCOMPANYING .THE GRANT OF SUCH <br />/ <br />FRANCHISE; PROVIDING FOR REGULATION.' AND LEASE <br />OF SUCH SYSTEM; PROVIDING FOR ~N' EFFECTIVE <br />DATE. . <br /> <br />WHEREAS, on Apri115, 1999, the City of Sunny Isles Beach shall have adopted Ordinance <br />No. 99-~, providing the terms and conditions for the operation of the Cable Television System <br />and the application procedures and requirements relating to the grant of franchises; and <br /> <br />WHEREAS, in January, the City was notified ofRifkin/Narragansett a South Florida Cable <br />TV Limited Partnership intended to transfer its assets to Interlink Communications Partners, LLP; <br />and upon the receipt ofthat notice the City began negotiations with said Franchisee for a franchise <br />agreement based on the terms and conditions set forth in Exhibit "A" attached hereto and made a part <br />hereof; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />1. Approval of Franchise Agreement. The City hereby approves the Agreement relating to <br />Florida Cable Television Ordinance No. 99- ~ and granting a franchise to own, operate <br />and maintain cable television system in the City on the terms and conditions set forth in <br />Exhibit "A" hereto, and made a part hereof. <br /> <br />2. Execution of Franchise Agreement. This approval is granted on the condition that <br />Franchisee agree to be bound by the terms and conditions set forth in the franchise <br />agreement, as well as Ordinance No. 99-~ (Franchise Ordinance) and shall execute said <br />Agreement within 15 days from the date of this Resolution, ifit has not already done so. <br /> <br />3. Non-substantive Changes. The City Manager is authorized to make any non-substantive and <br />immaterial changes to the agreement as may be necessary prior to its execution. <br /> <br />Cable Agreement Resolution <br /> <br />-1- <br />
