RESOLUTION NO. 2000- IS4 <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, <br />AUTHORIZING AN AGREEMENT BY AND BETWEEN <br />THE CITY OF SUNNY ISLES BEACH AND TROPIC <br />LANDSCAPING & LAWN MAINTENANCE, INC., <br />ATTACHED HERETO AS EXHIBIT "A", FOR THE <br />INSTALLATION OF NEW TREES IN THE PASSIVE PARK, <br />TRANSPLANTING OF FULLY MATURE TREES FROM <br />THE ACTIVE PARK SITE TO THE PASSIVE PARK, AND <br />PERFORMANCE OF DRAINAGE IMPROVEMENTS AS <br />SUGGESTED BY MIAMI-DADE COUNTY DEPARTMENT <br />OF ENVIRONMENTAL RESOURCES MANAGEMENT <br />(DERM) STORMWATER DIVISION, IN THE AMOUNT OF <br />$57,775.50; AND ALSO RATIFYING THE PRIOR <br />EXPENDITURE OF $78,761.00 PAID TO TROPIC <br />LANDSCAPING AND LAWN MAINTENANCE, INC. SINCE <br />FEBRUARY 2000; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, $78,761.00 has been paid to Tropic Landscaping & Lawn Maintenance, <br />Inc., landscape contractor for the Passive Park, as discussed at the February 10, 2000 City <br />Commission meeting, for the transportation of fill, leveling, resodding, and temporary tree <br />removal and storage, and <br />WHEREAS, the Miami -Dade County Department of Environmental Resources <br />Management (DERM) Stormwater Division refused to allow the City to utilize the proposed <br />stormwater system to alleviate water from the park, and suggested other alternatives for retaining <br />the required amount of stormwater on site; and <br />WHEREAS, the landscaping contractor and City environmental staff feel that previously <br />selected plant species were inappropriate for both the site and elevation, and, therefore, suffered <br />significantly, and <br />WHEREAS, the landscaping contractor and City environmental staff have selected trees <br />that will not only withstand the rigors of the barrier island system, but species and sizes that will <br />offer immediate impact through color, texture, and most importantly size. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of Contract. <br />(A) The contract by and between the City of Sunny Isles Beach and Tropic <br />Landscaping & Lawn Maintenance, Inc. in the amount of $57,775.50, <br />attached hereto as Exhibit "A," be, and the same, is hereby approved. <br />1 <br />
