<br />RESOLUTION NO. 2001-~ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CITY <br />MANAGER TO COMPROMISE, SETTLE AND PAY ALL CLAIMS <br />WHICH MAY BE DISCHARGED BY A PAYMENT OF AMOUNT NOT <br />TO EXCEED TEN THOUSAND DOLLARS ($10,000) FOR EACH <br />INDIVIDUAL CLAIM; FURTHER AUTHORIZING THE CITY <br />MANAGER AND THE CITY ATTORNEY TO COMPROMISE, <br />SETTLE AND PAY ALL CLAIMS WHICH MAY BE DISCHARGED <br />BY AN AMOUNT IN EXCESS OF TEN THOUSAND DOLLARS <br />($10,000) BUT NOT MORE THAN TWENTY-FIVE THOUSAND <br />DOLLARS ($25,000) FOR EACH INDIVIDUAL CLAIM REQUIRING <br />THAT ANY PROPOSED SETTLEMENTS IN EXCESS OF TWENTY- <br />FIVE THOUSAND ($25,000) FOR AN INDIVIDUAL CLAIM SHALL BE <br />SUBMITTED TO THE CITY COMMISSION FOR ITS APPROVAL; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the general liability risk management program is administered by the <br />City Manager or his designee; and <br /> <br />WHEREAS, from time-to-time claims are made which may, after some negotiation, be <br />subject to settlement and/or compromise; and <br /> <br />WHEREAS, up to a certain amount the City Commission wishes to delegate that <br />authority to the City Manager up to an amount of $10,000 and to the City Manager and City <br />Attorney collectively, between $10,000 and $25,000 with all proposed settlements in excess of <br />$25,000 to be reviewed by the City Commission for its approval; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF <br />THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />1. Authorization of City Manager. The City Commission hereby authorizes the City Manager <br />to compromise, settle and pay all claims which may be discharged by a payment of amount <br />not to exceed ten thousand dollars ($10,000) for each individual claim. <br /> <br />2. Authorization of City Manager and City Attorney, collectively. The City Commission <br />hereby authorizes the City Manager and City Attorney collectively, to compromise, settle <br />and pay all claims which may be discharged, by an amount in excess of ten thousand <br />dollars ($10,000) but not more than twenty-five thousand dollars ($25,000) for each <br />individual claim.
