<br />RESOLUTION NO. 2001- 39..N <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING <br />THE WAIVER OF ADDITIONAL OCCUPATIONAL <br />LICENSE DELINQUENCY PENALTIES, SO AS TO NOT <br />EXCEED THE 10% DUE IN OCTOBER OF 2001 FOR LATE <br />OCCUPATIONAL LICENSE RENEWAL PAYMENTS; <br />PROVIDING FOR THE TEMPORARY WAIVER THROUGH <br />JANUARY 31, 2002; PROVIDING FOR A CONDITION <br />PRECEDENT; PROVIDING FOR CONTINUING PENAL TIES <br />FOR CODE ENFORCEMENT; AND PROVIDING FOR AN <br />EFFECTIVE PERIOD AND EFFECTIVE DATE. <br /> <br />WHEREAS, the Statewide Tourism Industry is ailing since the September 11 th, 2001 tragedy <br />negatively impacting our local economy; and <br /> <br />WHEREAS, the Office of the City Manager and the Code Enforcement and Licensing <br />Department wish to give some incentive to try to ease some of the financial burdens on our local <br />businesses <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Amnesty. Notwithstanding anything to the contrary, the City of Sunny Isles Beach <br />hereby declares a special period for the reduction of occupational license delinquency penalties so as <br />to not exceed the 10% penalty due in October of2001 per ordinance numbers 98-45, 99-60, 99-81 <br />and 2000-102 as applicable to the City of Sunny Isles Beach to be known as the "Amnesty Period" <br />within the corporate limits of the City of Sunny Isles Beach. All other sections of ordinance <br />numbers 98-45, 99-60, 99-81, and 2000-102, as adopted, shall remain in full force and effect. <br /> <br />Section 2. Condition Precedent. All local business must utilize this amnesty period to renew <br />their occupational licenses as required, provided however there will be no imposition of additional <br />penalty of 5% per month as directed by the City Code of Ordinances. <br /> <br />Section 3. Penalties for Code Violation. Except as set forth in Section 1. hereunder, the Code <br />Enforcement and Licensing Department Director may at all times continue enforcement of the <br />applicable Codes through any authorized means including issuance of a Warning Notice of Violation <br />and/or the issuance of a Civil Notice of Violation and associated penalties. This Resolution shall not <br />be construed or serve as a defense against any enforcement actions brought by the Code Enforcement <br />and Licensing Department Director based on other requirements of the code. <br /> <br />Occ License Late Penalty Waiver Reso <br />
