<br />180 days after commencement of work. After commencement of work on the Contract, it shall <br />be pushed with proper dispatch toward completion to the satisfaction of the City, and shall be <br />fully completed within the time limit. It is understood and agreed that the time limit for <br />completion of said work is the essence of the Contract, and should the party of the second part <br />fail to complete the work within the time limit, it is agreed that for each calendar day that any <br />work provided for in these Plans and Specifications shall remain incomplete after the time limit <br />has expired, including any official extension of time limit, the sum per day given in the following <br />schedule shall be deducted from monies due the Contractor, not as a penalty, but as liquidated <br />damages and added expense for supervision. <br /> <br />Amount of Liquidated Damages and <br />Estimated Cost of Supervision per Day <br /> <br />$1.000.00 <br /> <br />Failure of the City to assess Liquidated Damages shall not be construed as a waiver of its ability <br />to assess Liquidated Damages prior to the preparation of final payment. <br /> <br />The Contractor shall take into account all contingent work which has to be done by other parties <br />arising from any cause whatsoever, and shall not plead his want of knowledge of said contingent <br />work as an excuse for delay in his work, or for its own performance. <br /> <br />8. Audit Rie:hts: The City retains the right to audit all work performed on a force-account <br />basis, and also to audit the work performed under lump sum change orders, such rights being <br />retained for a period of one (1) year after acceptance of the work by the City, provided, however, <br />that said audit rights shall not apply to lump sum changes after oavrnent has been made by the <br />City for said changes. <br /> <br />9. Contract Documents: The Documents hereinafter listed shall form the Contract, <br />and they are as fully a part of the Contract as if attached hereto. <br /> <br />1. Advertisement for Bids <br />2.
