<br />RESOLUTION NO. 2002-~~ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, DIRECTING THE CITY ATTORNEY <br />TO RETAIN THE SERVICES OF DIANA GRUB FRIESER, ATTORNEY- <br />AT-LAW, AS OUTSIDE ZONING COUNSEL, SPECIFICALLY TO <br />REVIEW THE PROPOSED LAND DEVELOPMENT REGULATIONS, <br />OF THE CITY OF SUNNY ISLES BEACH, FOR A FIXED FEE OF <br />$25,000.00, WITH THE WORK TO BE CONCLUDED WITHIN 90 DAYS <br />FROM COMMENCEMENT; AUTHORIZING THE CITY ATTORNEY <br />AND THE CITY MANAGER TO DO ALL THINGS NECESSARY TO <br />ASSIST IN THIS TASK; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach was incorporated on June 17, 1997; and <br /> <br />WHEREAS, pursuant to Florida Statutes Section 163.3167 (4), the City has prepared a <br />Comprehensive Development Plan; and <br /> <br />WHEREAS, the City of Sunny Isles Beach has prepared its proposed Land Development <br />Regulations in compliance with the City's Comprehensive Development Plan; and <br /> <br />WHEREAS, the City Attorney has determined a further legal review of the City's proposed <br />Land Development Regulations for consistency with the Comprehensive Plan, among other things, <br />by outside zoning counsel, is in the best interest of the City because of time constraints; and <br /> <br />WHEREAS, Diana Grub Frieser, Attorney-at-Law, the current City Attorney for the City of <br />Boca Raton and the former First Assistant City Attorney in charge of all zoning matters for the City <br />of Miami Beach, has had extensive experience in land development and growth issues; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Directive to City Attorney. The City Attorney is hereby directed to retain the <br />services of Diana Grub Frieser, Attorney-at-Law, for legal review and redrafting, as necessary, of <br />the City of Sunny Isles Beach's proposed Land Development Regulations, in consultation with Jack <br />Luft and other City personnel and/or consultants for a fixed fee of $25,000.00, with the work to be <br />concluded within 90 days from commencement. Other legal work may be required on an hourly <br />basis, provided, however, in the event that such hourly work will exceed $3,000.00, the City <br />Attorney shall return to the City Commission for approval. <br /> <br />Section 2. Authorization to City Manager and City Attorney. The City Manager and the City <br />Attorney is hereby authorized to do all things necessary to assist in this task. <br /> <br />Section 3. <br /> <br />Effective Date.
