<br />RESOLUTION NO. 2002- 432 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CITY <br />MANAGER TO PAY THE WEITZ COMPANY LLC ("CONTRACTOR") <br />A CONTRACTOR'S FEE FOR PRECONSTRUCTION SERVICES <br />DURING THE PRECONSTRUCTION PHASE OF THE DEVELOPMENT <br />OF THE CITY GOVERNMENT CENTER LOCATED AT 18050 COLLINS <br />AVENUE, IN AN AMOUNT NOT TO EXCEED TWELVE THOUSAND <br />FIVE HUNDRED DOLLARS ($12,500.00) PER MONTH FROM NO <br />LONGER THAN MARCH 15, 2002 THROUGH OCTOBER 15, 2002 <br />EXCLUDING ANY DELAYS OUTSIDE THE CONTROL OF THE <br />CONTRACTOR, TO BE BILLED ON A MONTHLY BASIS AND <br />PENDING APPROVAL OF A CONSTRUCTION BUDGET AND <br />STANDARD FORM OF AGREEMENT BETWEEN OWNER AND <br />CONTRACTOR FOR A NEGOTIATED GUARANTEED MAXIMUM <br />PRICE; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, by Resolution 2002-419 the City Commission approved the ranking of <br />construction management firms for the construction of the City Hall and Tony Roma's <br />Restaurant located at 18050 Collins Avenue; and <br /> <br />WHEREAS, the Weitz Company was selected as the number one ranked firm to work in <br />concert with Spillis Candela (the City's architects) whose contract was approved by Resolution <br />2001-398; and <br /> <br />WHEREAS, the Weitz Company has already begun to work with Spillis Candela in the <br />preconstruction phase for which the City Manager needs Commission authorization for payment <br />of a fee for such services, which the Weitz Company advises shall not exceed Twelve Thousand <br />Five Hundred Dollars ($12,500.00) per month from no longer than March 15, 2002 through <br />October 15, 2002 excluding any delays outside the control of the Contractor; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH AS FOLLOWS: <br /> <br />Section 1. Approval of Preconstruction Fee. The City Manager is hereby authorized to <br />pay the Weitz Company LLC ("Contractor") a fee for services during the preconstruction phase, <br />not to exceed $12,500.00 per month from no longer than March 15, 2002 through October 15, <br />2002 excluding any delays outside the control of the Contractor, which shall include all costs <br />related to the preconstruction services with the exception of blueprinting costs, which shall be <br />billed separately and charged at cost. The preconstruction fee shall be billed monthly with <br />invoices submitted by the tenth of the following month and payment shall be made within 20 <br />days of receipt of the invoice. <br /> <br />R2002-432 Weitz - Construction New City Hall <br /> <br />1 <br />
