<br />RESOLUTION NO. 2002- 475 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, APPROVING THE TEMPORARY WAIVER OF <br />SECTION 33-95(F) OF THE CITY CODE OF ORDINANCES AS ADOPTED <br />WITH CONDITIONS; PROVIDING FOR THE TEMPORARY WAIVER <br />THROUGH JANUARY 31, 2003; PROVIDING FOR PENALTIES; <br />PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach is a major tourist destination in Florida; and <br /> <br />WHEREAS, tourist based businesses located in the city have suffered tremendous financial <br />hardships since the tragic events of September 11 th; and <br /> <br />WHEREAS, the City Commission wishes to stimulate the local economy by providing local <br />businesses with an opportunity to maximize advertisement; <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />]Section 1-1. Amnesty. <br /> <br />Notwithstanding anything to the contrary, the City of Sunny Isles Beach hereby declares a special <br />period for the temporary waiver of section 33-95(f) of the City of Sunny Isles Beach code of <br />ordinances for all businesses within the City. Specifically allowing temporary banner signs for <br />advertisement for a period not to exceed four months to be known as the "Amnesty Period". All <br />other sections of the City Code of Ordinances as adopted shall remain in full force and effect. <br /> <br />.Section 1-2. Conditions. <br /> <br />All such banner signs shall be subject to the review and approval of the Zoning Director of the <br />Planning, Zoning, and Building Department prior to their placement on any structure. The City <br />reserves the right to reject banner signs that may impose a threat to the general welfare of our <br />residents and visitors. <br /> <br />!Section 1-3. Penalties for Violation. <br /> <br />Notwithstanding the provisions of this Resolution, the Zoning Director, Building Official, and Code <br />Enforcement and Licensing Department Director may at all times continue enforcement of the <br />applicable Codes through any authorized means including issuance of a Warning Notice of Violation <br />and/or the issuance of a Civil Notice of Violation and associated penalties. This Resolution shall not <br />be construed or serve as a defense against any enforcement actions brought by any Department based <br />on other requirements of the code. <br />
