<br />Amendment No. 1 to Agreement Between Owner and Contractor <br /> <br />Pursuant to Article 4 and Article 5 of the Agreement, dated May 3, 2002 between the City of Sunny Isles Beach (Owner) and <br />The Weitz Company, LLC. (Contractor), for Tony Roma's Restaurant and Phase I Sitework (the Project), the Owner and <br />Contractor establish a Guaranteed Maximum Price and Contract Time for the Work as set forth below. <br /> <br />ARTICLE I <br />GUARANTEED MAXIMUM PRICE <br /> <br />The Contractor's Guaranteed Maximum Price for the Work, including the estimated Cost of the Work as defmed in Article 7 and the <br />Contractor's Fee as defined in Article 5, is One Million Five Hundred Fifty-Five Thousand Seven Hundred Forty-Six dollars <br />($1,555,746.00). <br /> <br />The Scope of work included in the Guaranteed Maximum Price above is the first phase of an anticipated two (2) phases of work. The <br />Project identified as Phase I, consists of a new Tony Roma's Restaurant shell only with exterior finishes and related site improvements <br />consisting of utility services to within 5 feet of the building, approximatley 51 parking spaces, and landscaping and irrigation around <br />the building. <br /> <br />This GMP is for the perfonnance of the Work in accordance with the Contract Documents listed and attached to this Amendment and <br />marked Exhibits A through D, as follows: <br /> <br />Exhibit A <br /> <br />Drawings, Specifications, addenda and General, Supplementary and other Conditions of the Contract on which the <br />Guaranteed Maximum Price is based on page lA dated October 3, 2002. <br /> <br />Exhibit B <br /> <br />Scope of Work Check List, pages IB through 3B, Dated October 3, 2002. <br /> <br />Exhibit C <br /> <br />Assumptions and clarifications made in preparing the Guaranteed Maximum Price, pages lC through 3C, dated <br />October 3, 2002. <br /> <br />Exhibit D <br /> <br />Estimate Summary for Tony Roma's Shell and Phase I Sitework, Page 10, dated September 25,2002 <br /> <br />ARTICLE II <br />CONTRACT TIME <br /> <br />The date of Substantial Completion established by this Amendment is two hundred and forty-four (153) calendar days from the date <br />of commencement as outlined in Article 4.1 of the agreement. <br /> <br /> <br />CONTRACTOR <br /> <br />Date: \() II v <br /> <br /> <br />Date: Iv L( 02 <br /> <br />(Signature) <br /> <br />David Samson, Mayor <br />P~h i,IS" It lRJ....,.
