Amendment No. 1 to Agreement Between Owner and Contractor Pursuant to Article 4 and Article 5 of the Agreement, dated May 3, 2002 between the City of Sunny Isles Beach (Owner) and The Weitz Company, LLC. (Contractor), for Tony Roma's Restaurant and Phase I Sitework (the Project), the Owner and Contractor establish a Guaranteed Maximum Price and Contract Time for the Work as set forth below. ARTICLE I GUARANTEED MAXIMUM PRICE The Contractor's Guaranteed Maximum Price for the Work, including the estimated Cost of the Work as defmed in Article 7 and the Contractor's Fee as defined in Article 5, is One Million Five Hundred Fifty-Five Thousand Seven Hundred Forty-Six dollars ($1,555,746.00). The Scope of work included in the Guaranteed Maximum Price above is the first phase of an anticipated two (2) phases of work. The Project identified as Phase I, consists of a new Tony Roma's Restaurant shell only with exterior finishes and related site improvements consisting of utility services to within 5 feet of the building, approximatley 51 parking spaces, and landscaping and irrigation around the building. This GMP is for the perfonnance of the Work in accordance with the Contract Documents listed and attached to this Amendment and marked Exhibits A through D, as follows: Exhibit A Drawings, Specifications, addenda and General, Supplementary and other Conditions of the Contract on which the Guaranteed Maximum Price is based on page lA dated October 3, 2002. Exhibit B Scope of Work Check List, pages IB through 3B, Dated October 3, 2002. Exhibit C Assumptions and clarifications made in preparing the Guaranteed Maximum Price, pages lC through 3C, dated October 3, 2002. Exhibit D Estimate Summary for Tony Roma's Shell and Phase I Sitework, Page 10, dated September 25,2002 ARTICLE II CONTRACT TIME The date of Substantial Completion established by this Amendment is two hundred and forty-four (153) calendar days from the date of commencement as outlined in Article 4.1 of the agreement.
