<br />CONTRACTOR AGREEMENT NO. 02-08-01 <br /> <br />TIDS CONTRACTOR AGREEMENT made and entered into this 1S"~ day of <br />--.tJ ft\). 200 --1.J>y and between the CITY OF SUNNY ISLES BEACH, FLORIDA, ~ <br />municipal corporation of the State of Florida, (hereinafter referred as to "City") and PIOS & <br />SONS ENTERPRISES, INC., a Florida corporation, authorized to do business in the State of <br />Florida, (hereinafter referred to as "Contractor"), whose Federal I.D.# is <br />6S-()/Qgg79 <br /> <br />WHEREAS, Pios & Sons Enterprises, Inc., Inc., is a construction firm qualified to repair <br />and construct sidewalks, curbs and gutters and maintenance therefor; and <br /> <br />WHEREAS, the City wishes to employ Contractor to advise and assist with respect to <br />construction services more specifically described in Exhibit "A," attached hereto and made a part <br />hereof; and, <br /> <br />WHEREAS, the Contractor is qualified, willing and able to provide the desired services <br />on the terms and conditions set forth herein; <br /> <br />NOW THERFORE, in consideration of the premises and the mutual covenants herein <br />named, the parties hereto agree as set forth below: <br /> <br />1. RECITALS. The Recitals set forth above are hereby incorporated into this Agreement <br />and made a part of hereof for reference. <br /> <br />2. SERVICES TO BE PERFORMED. Contractor shall perform the following services: <br /> <br />a. Miscellaneous street improvement projects throughout the City, including repair and <br />construction of sidewalks, curbs and guttering and other services more particularly <br />described in Exhibit "A" attached hereto and made a part hereof. <br /> <br />b. Contractor will prepare and present oral reports as needed or as requested on a periodic <br />basis while engaged in special projects. Contractor shall provide, on a monthly basis, to <br />the City Manager, a detailed narrative report delineating all services provided by the <br />Contractor in the previous month. The Contractor shall also provide quarterly, written <br />reports, detailing all of the Contractor's activities in the previous quarter and the results <br />of the Contractor's efforts. Each report required herein will be submitted to the attention <br />of the City Manager. <br /> <br />c. The total price for these services is One Hundred Forty-One Thousand Eight Hundred <br />Fifty-Five and No/lOO Dollars ($141,855.00), which includes a 10% contingency, payable <br />in monthly installments, as invoiced. <br /> <br />3. TERM. Subject to the provisions relating to the termination of this Agreement as set <br />forth in Paragraph 8 hereunder, the term of this Agreement shall be from November 24,2002, to <br />May 24, 2003, and shall begin within ten (10) days after notification to proceed. Any change in <br />fee, terms or conditions shall be accomplished by written amendment to this contract. <br /> <br />9 <br />
