<br />RESOLUTION NO. 2003 - 5~ S <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ACCEPTING CONCEPTUAL PLANS <br />AS PREPARED BY O'LEARY DESIGN ASSOCIATES, P.A., FOR THE <br />159TH STREET LANDSCAPING; APPROVING AMENDMENT NO.1 TO <br />LANDSCAPING CONTRACT BY AND BETWEEN THE CITY OF <br />SUNNY ISLES BEACH AND VILA & SON LANDSCAPING CORP., FOR <br />LANDSCAPING AND IRRIGATION OF N.E. 159TH STREET, IN AN <br />AMOUNT OF ONE HUNDRED EIGHTY-ONE THOUSAND, FIVE <br />HUNDRED TWENTY-SIX DOLLARS AND FORTY CENTS ($181,526.40), <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR <br />TO EXECUTE SAID AMENDMENT; AUTHORIZING THE CITY <br />MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE <br />TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach's Landscape Architect, O'Leary Design <br />Associates, P.A., prepared plans for the 159th Street Landscaping; and <br /> <br />WHEREAS, the City hired Vila & Son Landscaping Corp. to perform landscaping and <br />improvements to Collins Avenue, approved by Resolution No. 2002-442; and <br /> <br />WHEREAS, the City requests additional work to be performed for landscaping and <br />inigation of N.E. 159th Street, for which Vila & Son submitted a proposal to the City in the <br />Amount of$181,526.40; and <br /> <br />WHEREAS, the City wishes to approve Amendment No.1 to Landscaping Contract, <br />attached hereto as Exhibit "A", with Vila & Son Landscaping Corp., in a total amount of <br />$181,526.40, for landscaping and irrigation ofN.E. 159th Street. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Accepting Conceptual Plans. The City Commission hereby accepts the <br />conceptual plans, as prepared by O'Leary Design Associates, P.A., for the 159th Street <br />landscaping. <br /> <br />Section 2. Approval of Amendment No. 1 to Landscaping Contract. Amendment No. I to <br />Landscaping Contract by and between the City of Sunny Isles Beach and Vila & Son <br />Landscaping Corp., for landscaping and irrigation of N.E. 159th Street, in an amount of <br />$181,526.40, attached hereto as Exhibit "A", be and the same, is hereby approved. <br /> <br />Section 3.
