<br />UFF.R[CBl. <br /> <br />2/18/PG3232 <br /> <br />. . <br /> <br />RESOLUTION NO.2003- 51) <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES <br />BEACH, FLORIDA, AMENDING RESOLUTION 2002-501 PROVIDING FOR THE <br />VACATION OF AN ALLEY RUNNING NORTH AND SOUTH FROM 185 STREET TO <br />191 STREET AS MORE FULLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR <br />THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City obtained jurisdiction over an alley designated as a utility easement <br />more specifically described in Exhibit "A" hereto pursuant to an Interlocal Agreement dated <br />November 4, 1997 by and between the City and Miami-Dade County; and <br /> <br />WHEREAS, pursuant to its home rule authority under Chapter 166, Florida Statutes and <br />the aforesaid Interlocal Agreement, the City has the authority to vacate, alter or discontinue any <br />public road over which it has jurisdiction; and <br /> <br />WHEREAS, the City Commission has determined that the alley described in Exhibit <br />"A" herein presently not used by the citizens or the City as a public right-of-way and the City is <br />proposing to vacate the alley; and <br /> <br />WHEREAS, the abutting property owners have agreed to honor all utility easements that <br />burden the alley prior to its abandonment by the City; and <br /> <br />WHEREAS, the City Commission has determined that the vacation of the alley will not <br />have an adverse impact on the citizens of the City of Sunny Isles Beach; and the vacation is in <br />the best interest ofthe public; and <br /> <br />WHEREAS, the City Commission has determined that the alley i s not being used by <br />abutting property owners for ingress and egress to their property. <br /> <br />WHEREAS, the City Commission, by Resolution 2002-501 adopted on December 10, <br />2002 attempted to vacate said alley with a map of the property to be vacated attached thereto as <br />but failed to attach a specific iegal description; and <br /> <br />WHEREAS, the City now wishes to attach such a legal description; <br /> <br />Vacation of the Alley 217/03 <br />JLVled <br /> <br />1 <br /> <br />'00.1 <br />~ <br />co <br />i;:;' <br />C.;"J <br />"'..1 <br />",. <br />il... <br /><l: <br />r''''J <br />c:o <br />- <br />(."".j <br />N <br />Wi <br />(I.t <br />Y':I <br />In <br />N <br />r.r: <br />M <br />I;:) <br />\ <br /> <br />f2- <br />
