<br />AMENDMENT NO.5 <br />TO LANDSCAPING CONTRACT BY AND BETWEEN <br />CITY OF SUNNY ISLES BEACH AND VILA & SON LANDSCAPING CORP. <br />DATED MAY 29, 2002 (BASE CONTRACT) <br />FOR ADDITIONAL LANDSCAPING & IMPROVEMENTS <br />FOR COLLINS AVENUE <br /> <br />WHEREAS, the Vila & Son Landscaping Corp. was hired by the City to perform landscaping <br />and improvements under the referenced contract for landscaping and irrigation of Collins <br />A venue and other sites within the City as approved by Resolution No. 2002-442; and <br /> <br />WHEREAS, pursuant to Paragraph 2 - Additional Services, of the Base Contract, the City <br />requests additional landscaping services for Collins A venue, for which the City has received a <br />Proposal dated February 16,2004, in the amount of $102,737.00; and <br /> <br />WHEREAS, the City, being satisfied with the performance and quality of workmanship of Vila <br />& Son, wishes to contract with Vila & Son Landscaping Corp., to perform this additional work <br />via this Amendment No.5 to Vila's landscaping contract referenced above; <br /> <br />NOW THEREFORE, in accordance with Vila and Sons proposal, dated, February 16, 2004 and <br />attached hereto as Exhibit "A," in the amount of $102,737.00, the City hereby amends Vila & <br />Son Landscaping contract as follows: <br /> <br />I. Additional landscaping and irrigation service to be performed at Collins A venue, as <br />more particularly described in the attached Exhibit "A." Payments to be made upon <br />completion <br /> <br />2. The total price for this project only is One Hundred Two Thousand, Seven <br />Hundred Thirty-Seven and 0/100 Dollars ($102,737). <br /> <br />3. The Base Contract dated May 29, 2002 is hereby extended to end of completion of <br />this project. <br /> <br />4.
