<br />CITY OF SUNNY ISLES BEACH, a Political <br />Subdivision of the State of Florida, <br /> <br />IN THE CIRCUIT COURT OF THE <br />11TH JUDICIAL CIRCUIT IN AND <br />FOR MIAMI-DADE COUNTY, <br />FLORIDA <br /> <br />Petitioner, <br /> <br />CASE NO.: 03-21419 CA 10 <br /> <br />18100 COLLINS AVENUE SHOPPING <br />CENTER, LTD.; et aI., <br /> <br />PARCEL NO,: 1 <br /> <br />Respondents, <br /> <br />/ <br /> <br />AMENDED AGREED ORDER ON ATTORNEYS' FEES <br /> <br />THIS CAUSE, having come before the Court upon Respondents' Amended Motion to <br /> <br />Tax Fees and Costs, IT IS ORDERED AND ADJUDGED THAT: <br /> <br />1, The Respondents, 18100 COLLINS AVENUE SHOPPING CENTER <br /> <br />LTD and RK ASSOCIATES NO.1 INC, ("Respondents"), are entitled to reasonable attorneys' <br /> <br />fees pursuant to Section 73,092(2), Florida Statutes for the dismissal of this cause. <br /> <br />2. Respondents shall recover as reasonable attorneys' fees for the dismissal of this <br /> <br />cause the sum of SEVENTY THOUSAND AND 001100 DOLLARS ($70,000.00). Such <br /> <br />reasonable attorney fees of $70,000.00 are inclusive of all attorney fees due to the Respondents <br /> <br />through to and including May 27, 2004, the date of the Voluntary Dismissal of these <br /> <br />proceedings, Respondents agree that the only remaining costs to be assessed against the City in <br /> <br />this cause is a reasonable appraisal fee for the services provided by American Valuation Inc. and <br /> <br />the deposition costs of Michael McElveen, Mitch Burnstein, and Harmon Garrin, <br /> <br />3. Within fifty (50) days of receipt of a conformed copy of this Order, Petitioner <br /> <br />shall issue a check for the above referenced amount of SEVENTY THOUSAND AND 00/1 00 <br /> <br />DOLLARS ($70,000.00) payable to Akerman Senterfitt and deliver said check to Bradley S, <br /> <br />{M2136563;1 } <br /> <br />Exhibit" A" <br />
