<br />RESOLUTION NO. 2004 -1''2.D <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, CONFIRMING THE <br />DECLARATION OF LOCAL EMERGENCY AS IMPOSED BY THE <br />CITY MANAGER DUE TO HURRICANE FRANCES, AND <br />CONFIRMING THE TERMINATION OF THE STATE OF A LOCAL <br />EMERGENCY; AUTHORIZING THE CITY MANAGER TO DO ALL <br />THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, on Thursday, September 2,2004, the Mayor of Miami-Dade County issued <br />a mandatory evacuation order due to the approaching storm, Hurricane Frances; and <br /> <br />WHEREAS, the City of Sunny Isles Beach faced dangerous conditions of sufficient <br />severity and magnitude to warrant coordinated local government action to prevent or alleviate the <br />damage, loss, hardship or suffering threatened or caused thereby; and <br /> <br />WHEREAS, Hurricane Frances caused a condition of extreme peril of life and property <br />necessitating the proclamation of the existence of an emergency and in accordance with <br />Ordinance No. 2002-163 of the Code of Sunny Isles Beach, the City Manager declared a local <br />emergency due to Hurricane Frances; and <br /> <br />WHEREAS, on Monday, September 6,2004, the Mayor of Miami-Dade County lifted <br />the evacuation order, and the City Manager of Sunny Isles Beach terminated the State of a Local <br />Emergency. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Confirmation of the Declaration of a Local Emergency, The Declaration of a <br />Local Emergency imposed by the City Manager, attached hereto as Exhibit "A", is hereby <br />confirmed by the City Commission of the City of Sunny Isles Beach, Florida, on September 2, <br />2004. <br /> <br />Section 2, Confirmation of the Termination of the State of Local Emergency, The City <br />Commission hereby confirms the termination of the State of Local Emergency on September 6, <br />2004, attached hereto as Exhibit "B", provided however this confirmation of termination shall not <br />be construed as a limitation on the City Manager's authority to declare a state of emergency at <br />any date subsequent to this resolution. <br /> <br />Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all <br />things necessary to effectuate the terms of this resolution. <br /> <br />Section 4. <br /> <br />Effective Date.
