<br />RESOLUTION NO. 2005- e,nS <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE <br />SECOND AMENDMENT TO THE AGREEMENT BETWEEN <br />THE CITY OF SUNNY ISLES BEACH AND MARLIN <br />ENGINEERING, INC., ATTACHED HERETO AS EXHIBIT "A", <br />IN THE AMOUNT NOT TO EXCEED SEVENTEEN THOUSAND, <br />FIFTY-FOUR DOLLARS AND NINETY CENTS ($17,053.90), FOR <br />ADDITIONAL SERVICES TO CONVERT CURRENT <br />ELECTRONIC FILES TO A FORMAT ACCEPTABLE TO <br />FLORIDA DEPARTMENT OF TRANSPORTATION AND <br />UPGRADE PEDESTRIAN CROSSWALK FOR THE SUNNY <br />ISLES BOULEVARD PROJECT; AUTHORIZING THE MAYOR <br />TO EXECUTE AMENDMENT TO AGREEMENT; <br />AUTHORIZING THE CITY MANAGER TO TAKE ANY AND <br />ALL ACTION AS MAY BE NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, on April 24, 2003, the City Commission adopted Resolution No. 2003-538 <br />approving an agreement with Marlin Engineering, Inc. ("Agreement"), in an amount of <br />$128,573.61, to provide advise and assistance with roadway improvements with respect to the <br />redevelopment of Sunny Isles Boulevard/SR826; and <br /> <br />WHEREAS, on October 23, 2003, the City Commission adopted Resolution No. 2003- <br />606, to modify that contract in scope and price, in an amount of $24,854.94, to include a <br />subsurface utility exploration, which required test borings to determine the subsurface conditions <br />("First Amendment"); and <br /> <br />WHEREAS, in relation to the project developing Sunny Isles Boulevard, the City has <br />requested that the Consultant provide additional services by: 1) converting the project's <br />landscape and lighting files from an AutoCADD format to a Florida Department of <br />Transportation approved format, and 2) performing the work necessary to upgrade the pedestrian <br />signals located within the project area; and <br /> <br />WHEREAS, Marlin Engineering, Inc. has submitted a proposal, and the City wishes to <br />accept the proposal modifying the agreement to include this work, in an amount not to exceed <br />$17,053.90, for a total contract amount of $170,482.45, attached hereto as Exhibit "A"; and <br /> <br />WHEREAS, this Second Amendment will also extend the Agreement until April 30, <br /> <br />2006. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1.
