<br />RESOLUTION NO. 2005- ~ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AWARDING BID NO. 05-04-01181sT <br />DRIVE ACTIVE PARK, ATTACHED HERETO AS EXHIBIT "A", TO <br />SIL TEK GROUP INC.; AUTHORIZING THE CITY MANAGER TO <br />NEGOTIATE AND ENTER INTO AN AGREEMENT WITH SIL TEK IN <br />SUBSTANTIALLY THE SAME FORM AND AMOUNT ($7,154,303.05) AS <br />THE AGREEMENT ATTACHED HERETO AS EXHIBIT "B", <br />PROVIDED THAT AGREEMENT IS APPROVED AS TO FORM AND <br />LEGAL SUFFICIENCY BY THE CITY ATTORNEY; FURTHER <br />PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO <br />ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS <br />AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach wishes to develop the 181 s1 Drive Active <br />Park, located at 18115 North Bay Road, as a public recreation facility consisting of a baseball <br />field with lighting, perimeter on-street parking, a new recreation center, a new gymnasium, <br />landscape, infrastructure, and miscellaneous site amenities; and <br /> <br />WHEREAS, the City publicly advertised Bid No. 05-04-01, incorporated by reference <br />and made a part hereof, for the construction of the 181 s1 Drive Active Park, and twelve (12) bid <br />packages were picked up by potential bidders; and <br /> <br />WHEREAS, on May 17,2005, eight (8) potential bidders attended the mandatory pre-bid <br />conference and tour; and <br /> <br />WHEREAS, Siltek Group Inc.'s ("Siltek") bid, attached hereto as Exhibit "A", was the <br />lowest and most responsive, responsible bidder with a sealed bid of Seven Million One-Hundred <br />Fifty-Four Thousand, Three Hundred Three Dollars and Five Cents ($7,154,303.05), attached <br />hereto as Exhibit "A"; and <br /> <br />WHEREAS, the City wishes to enter into an agreement with Siltek, which the City <br />Manager will further negotiate, in substantially the same form and amount ($7,154,303.05) as the <br />agreement attached hereto as Exhibit "B"; and <br /> <br />WHEREAS, the final negotiated agreement will be reviewed as to form and legal <br />sufficiency by the City Attorney. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The recitals set forth in this resolution are incorporated <br />herein by reference as if fully set forth herein. <br /> <br />Section 2. Award of Bid.
