In connection with the approved resolutions the <br /> developer proffered a Declaration of Restrictive Covenants. <br /> The property owners are requesting a release of the Declaration of Restrictive Covenant since the <br /> project approved under the resolutions will not be developed. Under Section 265-11 (N) of the <br /> Code of Sunny Isles Beach all Development Orders issued by the City shall be valid for a period of <br /> 24 months from the date of issuance and a building permit must be obtain during said 24 months or <br /> the Development Order shall be deemed null and void. <br /> Any new development and covenant will need to come before the City Commission for approval. <br /> Upon the partial release of the Declaration of Restrictive Covenants, all covenants and restrictions <br /> recorded prior to the zoning approval of resolution 98-Z-23 shall remain in full affect, unless a <br /> release for such has been recorded. <br /> Agenda Item <br /> Date <br />
