<br />RESOLUTION NO. 2005 - <641'3 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, RATIFYING THE "DECLARATION <br />OF A LOCAL EMERGENCY" IMPOSED BY THE INTERIM CITY <br />MANAGER ON OCTOBER 23, 2005 AND THE "TERMINATION OF A <br />LOCAL EMERGENCY" ISSUED ON NOVEMBER 1, 2005 DUE TO <br />HURRICANE WILMA; AUTHORIZING THE CITY MANAGER TO DO <br />ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach faced dangerous conditions of sufficient <br />severity and magnitude to warrant coordinated local government action to prevent or alleviate the <br />damage, loss, hardship or suffering threatened or caused thereby; and <br /> <br />WHEREAS, the Mayor of Miami-Dade County declared a State of Emergency for all of <br />Miami-Dade County due to the threat of impending Hurricane Wilma; and <br /> <br />WHEREAS, Hurricane Wilma caused a condition of extreme peril of life and property <br />necessitating the proclamation of the existence of an emergency and in accordance with <br />Ordinance No. 2002-163 of the City of Sunny Isles Beach, the Interim City Manager declared a <br />local emergency due to Hurricane Wilma; and <br /> <br />WHEREAS, the Mayor of Miami-Dade County has since lifted the State of Emergency <br />for Miami-Dade County; and <br /> <br />WHEREAS, the emergency dangers and threats of Hurricane Wilma have passed the \ <br />Interim City Manager of the City of Sunny Isles Beach has terminated the State of a Local <br />Emergency. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Confirmation of Declaration of a Local Emergency. The City Commission of the <br />City of Sunny Isles Beach hereby ratifies the "Declaration of a Local Emergency" imposed by the <br />City Manager on October 23,2005, attached hereto as Exhibit "A". <br /> <br />Section 2. Confirmation of Termination of the State of Local Emergency. The City <br />Commission of the City of Sunny Isles Beach hereby ratifies the "Termination of a Local <br />Emergency" issued by the City Manager on November 1, 2005, attached hereto as Exhibit "B", <br />provided however this confirmation of termination shall not be construed as a limitation on the <br />City Manager's authority to declare a state of emergency at any date subsequent to this <br />resolution. <br /> <br />Section 3. Authorization of City Manager.
