<br />D' <br /> <br />RESOLUTION NO. 2006- cg 81 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING <br />AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF <br />SUNNY ISLES BEACH AND MIAMI-DADE COUNTY FOR <br />THE CONSTRUCTION OF THE CENTRAL ISLAND <br />STORMWATER DRAINAGE PROJECT; AUTHORIZING <br />THE CITY ATTORNEY AND CITY MANAGER TO DO ALL <br />TIDNGS NECESSARY TO EFFECTUATE THE TERMS OF <br />THE INTERLOCAL AGREEMENT AND TO ACCEPT $2.5 <br />MILLION DOLLARS FROM THE BUILDING BETTER <br />COMMUNITIES GENERAL OBLIGATION BOND <br />PROGRAM; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach is situated on a barrier island with an average <br />elevation of six (6) feet above mean sea level, and the existing drainage systems are decades old and <br />sediments and other debris have collected in the pipes over time making them impermeable and <br />leaving the City vulnerable to flooding; and <br /> <br />WHEREAS, on or about July 20, 2004, the Miami-Dade County Board of County <br />Commissioners (the County) authorized a referendum for the issuance of $2.926 billion in general <br />obligation bonds from the Building Better Communities General Obligation Bond Program for <br />countywide capital projects, which was approved by a majority vote (the BBC GOB Program); and <br /> <br />WHEREAS, the Mayor and Commission of the City of Sunny Isles Beach wish to construct <br />a storm water drainage system for Central Island to remediate the potential flooding. This project <br />was specifically approved by the BBC GOB Program; and <br /> <br />WHEREAS, the Central Island drainage project is estimated to cost $5,500,000 and the <br />County has allocated funds in the amount of $2,500,000 from the BBC GOB Program for that <br />project; and <br /> <br />WHEREAS, the Mayor and City Commission wish to authorize the City Manager to <br />execute an interlocal agreement to allow the receipt and expenditure of the County funds for this <br />project. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Authority to City Manager. The Mayor and Commission of the City of Sunny Isles <br />Beach, hereby authorize the City Manager to execute an interlocal agreement with Miami-Dade <br />County, and all related documents, for the receipt and expenditure of the BBC GOB Program funds <br />to construct the Central Island Drainage Project. <br /> <br />Section 2. <br /> <br />Authority of the City Manager and City Attorney.
