<br />RESOLUTION NO. 2006-.9.li <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE <br />ORDER NO. 4 TO THE 159TH STREET AND 174TH STREET <br />ROADWAY LIGHTING IMPROVEMENTS AGREEMENT WITH <br />HORSEPOWER ELECTRICAL, INC. FOR ADDITIONAL <br />INSTALLATION OF NEW STREET LIGHTS ON NORTH BAY <br />ROAD, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED AND <br />FIFTY-SIX THOUSAND THREE HUNDRED NINETY-FOUR <br />DOLLARS AND TWENTY-TWO CENTS ($156,394.22), <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE <br />CITY MANAGER TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THE TERMS OF THIS AGREEMENT; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, pursuant to Resolution No. 2004-706, adopted on September 9, 2004, the <br />City Commission approved a Street Roadway Lighting Improvements Agreement for NE 159th <br />Street and NE 174m Street (Master Agreement) with Horsepower Electrical, Inc. (Contractor) in <br />an amount not to exceed One Hundred Seventy-Nine Thousand Nine Hundred and Seventy-One <br />Dollars ($179,971.00), and on July 14, 2005, Change Order No.2 and 3 via Resolution No. 2005- <br />813 in the amount of $15,959.67 and $34,387.00 respectively, coupled with the administratively <br />approved Change Order No.1, bringing the total amount to $240,312.67; and <br /> <br />WHEREAS, on May 9, 2006, Contractor submitted Change Order No.4 to the City's <br />project engineer, Calvin Giordano & Associates, Inc., for the installation of new street lights on <br />North Bay Road which will cost the City an additional One Hundred Fifty-Six Thousand Three <br />Hundred Ninety-Four Dollars and Twenty-Two Cents ($156,394.22); and <br /> <br />WHEREAS, Contractor has also requested an extension of the Master Agreement <br />contract term for an additional Ninety (90) calendar days; and <br /> <br />WHEREAS, if approved by the City Commission, the total aggregate contract price for <br />the Master Agreement, will be Three Hundred and Ninety-Six Thousand Seven Hundred and Six <br />Dollars and Eighty-Nine Cents ($396,706.89); and <br /> <br />WHEREAS, the City wishes to continue using the services of the Contractor by <br />amending the term of the Master Agreement for 90 additional calendar days and increase the total <br />contract price to an amount not to exceed $396,706.89. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Approval of Change Order No.4. The City Commission hereby approves Change <br />Order No.4 to the 159th Street and 174th Street Roadway Lighting Improvements Agreement <br />with Horsepower Electrical, Inc., in an amount not to exceed One Hundred and Fifty-Six <br /> <br />R-2006-First Amendment To IS9th St. & NE 174th St. Roadway Lighting Improvements Agreement <br />Page 1 of2 <br />
