<br />RESOLUTION NO. 2007-l.l1lo <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA PROVIDING <br />FOR PUBLICATION OF THE ATLANTIC ISLE SANITARY <br />SEWER PRELIMINARY ASSESSMENT ROLL IN <br />ACCORDANCE WITH CHAPTER 170, FLORIDA <br />STATUTES; PROVIDING A DATE AND TIME FOR AN <br />EQUALIZATION HEARING ON THE PROPOSED <br />ATLANTIC ISLE SPECIAL ASSESSMENTS; PROVIDING <br />FOR MAILING OF NOTICE OF THE PUBLIC HEARING <br />TO OWNERS OF ASSESSED PROPERTY; PROVIDING <br />FOR PUBLICATION OF NOTICE OF THE HEARING; AND <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission (the "Commission") of the City of Sunny Isles <br />Beach, Florida (the "City") is considering the imposition of special assessments to fund a <br />portion of the cost of providing sanitary sewer improvements and associated road improvements <br />that will benefit and serve properties located on Atlantic Isle; and <br /> <br />WHEREAS, the Commission has adopted a Resolution declaring its intent to levy non- <br />ad valorem special assessments on property on Atlantic Isle to be benefited by the construction <br />of sanitary sewer improvements; <br /> <br />NOW, THEREFORE BE IT RESOL VED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1, Adoption of Resolution Declaring Intent to Special Assessment. The City <br />Commission has adopted a Resolution Declaring intent to levy Special Assessments in <br />accordance with Section 170.03, Florida Statutes, has provided for public inspection of an <br />assessment plat, plans and specifications and cost estimate as required under Section 170.04, <br />Florida Statutes, and has caused a Preliminary Atlantic Isle Assessment Roll to be prepared in <br />accordance with Section 170.06, Florida Statutes. <br /> <br />Section 2. Equalization Hearing. The City Commission hereby declares that a <br />hearing will be held on July 24, 2007 at 6:30 p.m. at the City Commission Chambers where <br />testimony from affected property owners may be heard as to the propriety and advisability of <br />making the Atlantic Isle sanitary sewer improvements and associated road improvements, the <br />manner of paying for the improvements, funding of such improvements with special <br />assessments on property, and the amount to be assessed against each benefited property. <br />Following such testimony, the Commission shall make a final decision on whether to levy the <br />special assessments, If the Commission determines to levy the special assessments, the <br />Commission shall then meet as an equalizing board to hear and consider any and all complaints <br />as to the special assessments and shall adjust and equalize the assessments on a basis of justice <br />and right. Based upon these determinations, the Commission may then approve a Final <br />Assessment Resolution with a Final Atlantic Isle Assessment Roll. <br /> <br />Section 3. <br /> <br />Notice. <br /> <br />Notice on the proposed Atlantic Isle Assessment shall be provided by <br />Page I of2 <br /> <br />R2007,_ Res Selling lIearing <br />
