RESOLUTION NO. 2007-l.l1lo A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA PROVIDING FOR PUBLICATION OF THE ATLANTIC ISLE SANITARY SEWER PRELIMINARY ASSESSMENT ROLL IN ACCORDANCE WITH CHAPTER 170, FLORIDA STATUTES; PROVIDING A DATE AND TIME FOR AN EQUALIZATION HEARING ON THE PROPOSED ATLANTIC ISLE SPECIAL ASSESSMENTS; PROVIDING FOR MAILING OF NOTICE OF THE PUBLIC HEARING TO OWNERS OF ASSESSED PROPERTY; PROVIDING FOR PUBLICATION OF NOTICE OF THE HEARING; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission (the "Commission") of the City of Sunny Isles Beach, Florida (the "City") is considering the imposition of special assessments to fund a portion of the cost of providing sanitary sewer improvements and associated road improvements that will benefit and serve properties located on Atlantic Isle; and WHEREAS, the Commission has adopted a Resolution declaring its intent to levy non- ad valorem special assessments on property on Atlantic Isle to be benefited by the construction of sanitary sewer improvements; NOW, THEREFORE BE IT RESOL VED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1, Adoption of Resolution Declaring Intent to Special Assessment. The City Commission has adopted a Resolution Declaring intent to levy Special Assessments in accordance with Section 170.03, Florida Statutes, has provided for public inspection of an assessment plat, plans and specifications and cost estimate as required under Section 170.04, Florida Statutes, and has caused a Preliminary Atlantic Isle Assessment Roll to be prepared in accordance with Section 170.06, Florida Statutes. Section 2. Equalization Hearing. The City Commission hereby declares that a hearing will be held on July 24, 2007 at 6:30 p.m. at the City Commission Chambers where testimony from affected property owners may be heard as to the propriety and advisability of making the Atlantic Isle sanitary sewer improvements and associated road improvements, the manner of paying for the improvements, funding of such improvements with special assessments on property, and the amount to be assessed against each benefited property. Following such testimony, the Commission shall make a final decision on whether to levy the special assessments, If the Commission determines to levy the special assessments, the Commission shall then meet as an equalizing board to hear and consider any and all complaints as to the special assessments and shall adjust and equalize the assessments on a basis of justice and right. Based upon these determinations, the Commission may then approve a Final Assessment Resolution with a Final Atlantic Isle Assessment Roll. Section 3. Notice.
