<br />RESOLUTION NO. 2007-.1l..59 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, RATIFYING THE DISPOSAL OF A <br />1999 EURO-LITE LEGACY SHUTTLE BUS AS SURPLUS PROPERTY; <br />PROVIDING THE CITY MANAGER AND THE CITY ATTORNEY <br />WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THE DISPOSAL OF THE 1999 EURO-LITE LEGACY <br />SHUTTLE BUS; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, on March 28, 2000, the City of Sunny Isles Beach, Florida (the "City") purchased <br />a nineteen passenger 1999 Euro-Lite Legacy shuttle bus, vehicle identification number <br />IM9E621HOYG503001, (the "bus") through a public auction conducted by Michael Fox International <br />Inc., in Atlanta, Georgia; and <br /> <br />WHEREAS, the previous owner of the bus was Metrotrans, a company from Atlanta, Georgia, <br />that declared bankruptcy and auctioned off its assets, including the subject bus, on March 28, 2000, in <br />order to pay its creditors; and <br /> <br />WHEREAS, since purchasing the bus on March 28, 2000, the only documentation received by <br />the City in connection with the purchase includes a sales invoice and a photocopy of a State of Georgia <br />Tax Exemption Certificate; and <br /> <br />WHEREAS, the City's Attorney's Office and City's Police Department initiated numerous <br />communications with Michael Fox International Inc. and Metrotrans regarding proper title and <br />registration for the bus, to no avail; and <br /> <br />WHEREAS, the City's Police Department confirmed that the bus was never registered in any <br />state, including Florida, and that a certificate of title was never applied for by the previous owner; and <br /> <br />WHEREAS, the City remains unable to obtain a proper motor vehicle tag and title, given the <br />lack of registration and evidence of title from the original seller; and <br /> <br />WHEREAS, the bus is not part of the City's bus fleet and has been idly occupying City parking <br />space underneath the Lehman Causeway bridge for the past few years; and <br /> <br />WHEREAS, the City is unable to sell the bus without proper evidence of title and registration. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section I. Ratification of the disposal of shuttle bus. The City Attorney and the City Manager are <br />hereby authorized to do all things necessary to effectuate the disposal of the 1999 Euro-Lite Legacy <br />shuttle bus, vehicle identification number IM9E621HOYG503001, as surplus property. <br /> <br />Section 2 <br /> <br />Effective Date.
