<br />RESOLUTION NO. 2007-l1.:l..3- <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, DECLARING LEWIS J. THALER <br />AS COMMISSIONER SEAT 1, AND GEORGE "BUD" SCHOLL AS <br />COMMISSIONER SEAT 3, WHO WERE AUTOMATICALLY <br />ELECTED, HAVING NO OPPONENTS, FOR THE GENERAL <br />ELECTION WHICH WAS SCHEDULED ON TUESDAY, NOVEMBER <br />6,2007; DISCHARGING THE CANVASSING BOARD FOR SAID <br />GENERAL ELECTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach scheduled a General Election on Tuesday, <br />November 6, 2007; and <br /> <br />WHEREAS, City Resolution No. 2007-1132, designated Emanuel Pine to be the registered <br />voter to serve on the Canvassing Board with the City Manager, and City Clerk as Chairperson, for <br />the General Election; and <br /> <br />WHEREAS, the qualifying period for said Election was designated for Monday, September 10, <br />2007 at 9:00 a.m. to Thursday, September 13,2007 at 4:00 p.m.; and <br /> <br />WHEREAS, Lewis J. Thaler and George "Bud" Scholl were the sole candidates to qualify for <br />Commissioner Seat 1 and Seat 3, respectively; and <br /> <br />WHEREAS, Section 26-6 of the Sunny Isles Beach Municipal Code states that "pursuant to <br />Municipal Charter Section C-5.1(g), if at the close of the qualifying period there is only one duly <br />qualified candidate for Mayor or for any City Commission seat, that single candidate shall be <br />considered elected automatically"; and <br /> <br />WHEREAS, the Sunny Isles Beach Municipal Charter provides that "the term of office of any <br />elected official will commence on the 30th day following the day of the general or run-off election in <br />which he/she is elected, unless that day falls on a Saturday or Sunday, in which case it shall be the <br />next Monday immediately following, at 12 o'clock noon ("commencement term"), and will end at <br />midnight ofthe day before the commencement term."; and <br /> <br />WHEREAS, Lewis J. Thaler and George "Bud" Scholl are elected automatically to the <br />respective seats for which they have qualified, and their term of office will commence December 6, <br />2007, at 12 o'clock noon. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Declaring Automatically Elected. The City Commission of the City of Sunny Isles <br />Beach hereby declares that Lewis J.
