<br />RESOLUTION NO. 2007- I cl~ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, EXPRESSING AN INTENT TO <br />ACCEPT THE CONVEYANCE OF THE PROPERTY OWNED BY <br />MIAMI-DADE WATER AND SEWER IN THE CITY OF SUNNY <br />ISLES BEACH IF THE CONDITIONS ARE ACCEPTABLE TO THE <br />CITY MANAGER AND CITY ATTORNEY; PROVIDING THE CITY <br />MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO <br />DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Miami-Dade County ("COUNTY") owns fee simple title to certain real <br />property within the municipal corporate boundary of the City of Sunny Isles Beach, Florida in <br />Miami-Dade County, located at 350 Sunny Isles Blvd also known as Pump Station Number 301; <br /> <br />~, <br />." <br /> <br />WHEREAS, the City of Sunny Isles Beach ("CITY") is a municipal corporation created <br />pursuant to the Constitution of the State of Florida and the Home Rule Charter of Metropolitan <br />Dade County; <br /> <br />')" <br /> <br />WHEREAS, COUNTY has agreed to grant to CITY a right-of-way deed for ingress and <br />egress in, over, under, and upon the western edge of the W ASA Site which shall be twenty five <br />(25) feet in width and which extends from the public right of way of Sunny Isles Beach <br />Boulevard to the north and thirty six (36) feet to the south towards the wetland/upland line (the <br />"Road Access") for the purpose of constructing a public safety access road to and from the W ASA <br />Site, subject to the terms and conditions set forth in the Easement Agreement. <br /> <br />BE IT RESOLVED BY tHE CITY COMMISION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of recitals. The foregoing recitals are true and correct and are <br />incorporated herein by reference as if they are fully set forth herein. <br /> <br />Section 2. Intent to Accept Conveyance. The City Commission hereby states its intent to <br />accept a right-of-way deed from Miami-Dade Water and Sewer Association for ingress and <br />egress through the Road Access Area if the conditions are acceptable to the City Manager and <br />City Attorney. <br /> <br />Page lor 2 <br />
