<br />RESOLUTION NO. 2008-~ <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING AN <br />ADDENDUM TO THE PARKING LICENSE AGREEMENT <br />BETWEEN THE CITY OF SUNNY ISLES BEACH, FLORIDA, <br />AND FORTUNE BEACH, LLC FOR USE OF A PORTION OF THE <br />PARKING LOTS UNDER THE LEHMAN CAUSEWAY, <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE <br />MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING <br />THE CITY ATTORNEY AND THE CITY MANAGER TO DO ALL <br />THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS <br />AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, pursuant to Resolution No. 2005-807 the City of Sunny Isles Beach <br />("City") entered into a Parking License agreement with Fortune Beach, LLC ("Fortune") for use <br />of the parking lots and surrounding property under the Lehman Causeway; and <br /> <br />WHEREAS, the parties entered into an Amendment to City of Sunny Isles Beach <br />Parking License Agreement on April 11, 2006 (the "First Amendment"); and <br /> <br />WHEREAS, the Initial Term of the Agreement expired on June 30, 2008; and <br /> <br />WHEREAS, the parties have agreed to a one (1) year extension of the term of the <br />Agreement, which shall commence effective July 1, 2008 and expire on June 30, 2009 pursuant <br />to the terms provided in the Addendum to the Agreement, attached hereto as Exhibit "A". <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Approval of Agreement. The Addendum to the Parking License Agreement by <br />and between the City of Sunny Isles Beach and Fortune Beach, LLC, attached hereto as Exhibit <br />"A", be and the same, is hereby approved. <br /> <br />Section 2. Authorization of Mayor. The Mayor IS hereby authorized to execute said <br />Addendum to the Parking License Agreement. <br /> <br />Section 3. Authorization of the City Attorney and the City Manager. The City Attorney and <br />the City Manager are hereby authorized to do all things necessary to effectuate the terms of the <br />Addendum to the Parking License Agreement. <br /> <br />Section 4. <br /> <br />Effective Date.
