<br />RESOLUTION NO. 2008- 13} 8 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE <br />FIRST AMENDMENT TO AGREEMENT WITH B & G <br />FENCES, CORP., TO PROVIDE FURNISHING AND THE <br />INST ALLA TION OF FENCING FOR COLLINS A VENUE <br />MEDIANS, IN AN AMOUNT NOT TO EXCEED TWO <br />HUNDRED FORTY THOUSAND DOLLARS ($240,000.00), <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING <br />THE MAYOR TO EXECUTE SAID AGREEMENT; <br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THE TERMS OF THIS <br />RESOLUTION; PROVIDING FORAN EFFECTIVE DATE. <br /> <br />WHEREAS, on June 19, 2008, via Resolution No. 2008-1283, the City Commission <br />approved an agreement with B & G Fences, Corp. to provide and install 1,200 linear feet of <br />fencing in the medians on Collins A venue, in the amount of Ninety Thousand Four Hundred <br />Dollars ($90,400.00); and <br /> <br />WHEREAS, after approval of the agreement, it was discovered that the linear feet was <br />incorrect since it only covered a portion of Collins A venue median, and the City now wishes to <br />install an additional 4,800 linear feet of median fencing; and <br /> <br />WHEREAS, after negotiations, B & G Fences, Corp. submitted a proposal to include <br />the additional scope of work, with a lower price per linear foot, competitive and lower than the <br />original proposals; and <br /> <br />WHEREAS, in order to continue the fabrication and installation of the fence and <br />complete the work in a timely manner, the City wishes to amend the agreement to include the <br />additional scope of work, in the amount of Two Hundred Forty Thousand Dollars ($240,000.00) <br />to provide furnishing and the installation of a fence in the medians on Collins Avenue, attached <br />hereto as Exhibit "A". <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Approval of First Amendment to Agreement. The First Amendment to Agreement <br />with B & G Fencing, Corp., in the amount of Two Hundred Forty Thousand Dollars <br />($240,000.00) to provide and install fencing in the medians on Collins A venue, attached hereto as <br />Exhibit "A," be, and the same, is hereby approved. <br /> <br />Section 2. Authorization of Mayor. The Mayor IS hereby authorized to execute said <br />Agreement. <br /> <br />Section 3. Authorization of City Manager.
