<br />- <br /> <br />RESOLUTION NO. 2009- ~S <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE <br />PAYMENT OF THE PERFORMANCE BOND PREMIUM FOR THE <br />EMERGENCY DEBRIS REMOVAL CONTRACTOR; <br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, on September 18,2008, via Resolution No. 2008-1323, the City Commission <br />approved an agreement with Ashbritt, Inc., for Emergency Debris Collection and Removal <br />Operations to the City in response to Request for Proposals (RFP) No. 08-07-01; and <br /> <br />WHEREAS, the estimated cost for Ashbritt's services will be determined based on the <br />magnitude of the storm and the initial damage estimate, and the City will request reimbursement from <br />Federal granting agencies, if applicable; and <br /> <br />WHEREAS, to ensure that Ashbritt, Inc., would be here when we needed them, the <br />Commission required a performance bond; and <br /> <br />WHEREAS, Ashbritt did not acquire the bond last year, stating that they would have to <br />make a cash out-of-pocket payment without any guarantee that they would in fact be awarded any <br />work, which was the case because no hurricanes impacted Sunny Isles Beach; and <br /> <br />WHEREAS, Ashbritt has proposed, and staff agrees, that the City pay the annual bond <br />premium cost (approximately $5,500) and if an event occurs, Ashbritt would then reimburse the City <br />for all bond premiums paid to date; and <br /> <br />WHEREAS, the City Commission authorizes the payment of the performance bond <br />premium for Ashbritt, Inc. for emergency debris collection and removal operations, to be reimbursed <br />to the City if an event does occur. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Authorization of Payment of Performance Bond Premium. The City Commission <br />hereby authorizes the payment of the performance bond premium for Ashbritt, Inc. for emergency <br />debris collection and removal operations. <br /> <br />Section 2. Authorization of City Manager.
