<br />You will review your account statements prior to transmitting any Stop Payment Request. <br />You will not transmit any Stop Payment Request relating to a check that has been shown to <br />be paid on such statements. <br /> <br />In some cases, we may pay a check even if a Stop Payment Request is in effect. For example, if <br />one of our branches (or banking centers) or affiliates becomes a "holder in due course" of <br />the check that you asked us to stop, we may still pay the check. <br /> <br />The procedures for placing and acknowledging Stop Payment Requests are described in the <br />applicable User Documentation. <br /> <br />If you use any Online Stop Payment Services with respect to an account connected to a <br />Controlled Disbursement Service, you must follow the procedures in this section rather than <br />the Stop Payment procedul'es in the Controlled Disbursement Services section. <br /> <br />POSITIVE PAY <br /> <br />Our Positive Pay Services allow you to identify exception items, to request photocopies and/or <br />electronic images of exception items and to instl1lct us whether to payor return those items. <br />In many locations, if you send us an issue file, YOUl' information may be made available at <br />the teller line. This is called ''Teller Positive Pay", which helps identify fraudulent checks that <br />are presented for payment at many of our banking centers. With Teller Positive Pay, the <br />decision whether to pay such an item may be made by us at the teller line. <br /> <br />On each Business Day, we provide you a report of checks presented to us for payment on the <br />plioI' Business Day and which we have identified as exceptions based on information you <br />have provided to us and as more fully described in the applicable User <br />Documentation. Exceptions are determined by comparing checks presented to us (either by <br />other depository institutions or, where applicable, for cashing at one of our banking centers) <br />with lists of checks issued or canceled by you which you transmit electronically to us each <br />Business Day by the time specified in the applicable User Documentation. Alternatively, <br />where available, you may choose an option under which we l'eport all checks presented for <br />payment, in which case we will treat all such checks as exception items. <br /> <br />On the same day we report exception items to you, you must notify us, by the deadline <br />specified in the applicable User Documentation, which checks you want us to payor which to <br />dishonor and return. If you fail to notify us by the deadline, we will handle the exception <br />items in accordance with the prescribed default procedure (which you may choose where the <br />choice is available). Where required, you will indicate which checks you want us to return, <br />having been deemed by you to be fraudulent. Our deadlines, default procedures and <br />procedures for acknowledging pay and return requests are desclibed in the applicable User <br />Documentation.
