<br />- <br /> <br />We reformat and transmit your payment order to another bank, and we have no duty to do <br />so if your request is defective, incomplete, erroneous or inconsistent with the terms of this <br />Booklet. We may act on your Multibank instructions as we reasonably consider appropriate <br />notwithstanding any error, omission, defect or lack of clarity in its terms and even if the <br />instructions appear to duplicate other Multibank requests. You agree that your <br />indemnity of us, as set forth in the "Protection From Third Parties" section of this Booklet., <br />applies to any claims by another bank based on our sending a Multibank instl1lction <br />containing any error, omission, defect or lack of clarity. <br /> <br />If you wish to cancel or amend a payment order set forth in a Multibank instl1lction, you <br />must contact the bank to which the payment order is directed and act in accordance with its <br />procedures. <br /> <br />Reports on Multibank instmctions which we have processed will be included in an <br />Information Reporting Service which you have arranged to use. <br /> <br />COMPLIANCE WITH RULES AND LAWS <br />You agree to comply with all applicable payment system rules, including the national <br />payment system rules and any other applicable laws and regulations of the receiving country <br />of your transaction. You also agree to comply with the authorization and notice <br />requirements applicable to any Request to debit another person's account. <br /> <br />AUTHORIZED PERSONS <br />Before using a Wire Transfer or International Electronic Funds Transfer Selvice, you give <br />us a written list., in a form acceptable to us, of the persons authorized by you to perform <br />certain duties in connection with such Service. <br /> <br />SECURITY PROCEDURE <br />You agree to use a Service in accordance with the relevant Security Procedure, if any. The <br />purpose of the Security Procedure is to verify the authenticity of Requests delivered to us in <br />your name and not to detect errors in the transmission or content of Requests. You represent <br />and warrant each time you use a Wire Tl'ansfer or International Electronic Funds <br />Transfer Service that, in view of your requirements, the Security Procedure is a satisfactory <br />method of verifying the authenticity of Requests. <br /> <br />You agree that we may act on Requests, even if they are unauthorized, ifwe act in good faith <br />and comply with the applicable Security Procedure and any written agreement with you <br />restricting our action on Requests. In such cases, we may enforce or retain your payment to <br />us for such Requests; provided, however, we may not enforce or retain payment if you prove <br />that the unauthorized Requests were not caused by a person (i) entrusted at any time to act <br />for you with respect to Requests or the applicable Security Procedure, (ii) who obtained <br />access to your premises, computer equipment or transmitting facilities or (iii) who obtained, <br />from a source controlled by you, information (such as keys and passwords) which facilitated <br />breach of the applicable Security Procedure. <br /> <br />ACCOUNr DEBITS <br />You must have Collected and Available Funds in your account which, <br />when added to funds which may be made available under a line of credit, <br />are sufficient to cover your Requests. You may initiate a Request only if the offsetting <br />debit to your account., including the available line of credit., will not cause you to exceed the <br />account balance according to your records.
