FTA Circular 9030.1 Chapter V: Section 5: (D) Satisfactory Continuing Control <br /> (E) Maintenance <br /> Section 10: (A) Bus Facilities <br /> d. Satisfactory Continuing Control. Section 5307(d)(1)(B) provides that the <br /> grantee must annually certify that it "has or will have satisfactory continuing <br /> control over the use of the equipment and facilities . . . " through operation or <br /> lease or otherwise. <br /> An FTA grantee must maintain control over federally funded property; ensure that <br /> it is used in transit service, and dispose of it in accordance with Federal <br /> requirements. If the grantee leases federally funded property to another party, the <br /> lease must provide the grantee satisfactory continuing control over the use of that <br /> property. Control over FTA-funded facilities and equipment is determined in two <br /> areas: real property (land) and facilities; and personal property (equipment and <br /> rolling stock, both revenue and non-revenue). FTA requirements are for adequate <br /> property control as shown, for example, through an inventory system; for proper <br /> use and disposition of property as shown, for example, by conforming with FTA <br /> procedures described in the grants management circular (FTA C 5010.1C) for <br /> disposing of property; and for safeguards against loss, theft, or damage. <br /> e. Maintenance. The grant applicant must annually certify that pursuant to <br /> 49 U.S.C. Section 5307(d)(1)(C), it will maintain (federally funded) facilities <br /> and equipment. <br /> The grantee must keep equipment and facilities acquired with Federal assistance <br /> in good operating order. This includes maintenance of rolling stock (revenue and <br /> non-revenue), machinery and equipment, and facilities. Every grant recipient of <br /> Urbanized Area Formula Program funds must have in its files a maintenance <br /> plan. The maintenance plan should identify the goals and objectives of a <br /> maintenance program, which may include, for example, vehicle life, frequency of <br /> road calls, and maintenance costs compared to total operating costs. The <br /> maintenance program, therefore, should establish the means by which such <br /> goals and objectives will be obtained. <br />
