RESOLUTION NO. 2008 - 3 _0_1 _ <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AWARDING BID NO. 08 -06-0I TO AND <br />ENTERING INTO AN AGREEMENT WITH TENEX ENTERPRISES FOR <br />ATLANTIC: ISLES ROADWAY AND UTILITY IMPROVEMENTS, IN AN <br />AMOUNT NOT TO EXCEED TWO MILLION EIGHT HUNDRED EIGHTY - <br />FIVE THOUSAND FORTY - :EIGHT DOLLARS ($2,885,048.00), IN <br />SUBSTANTIAL,L.Y THE SAME FORM AS THE AGREEMENT ATTACHED <br />HERETO AS EXHIBIT "A ", PROVIDING 'THAT ANY CHANGES ARE <br />APPROVED AS TO FORM AND LEGAL SUFFICIENCY BY THE CITY <br />ATTORNEY, BASED ON THE PRICING, TERMS, AND CONDITIONS <br />LISTED IN THE BID RESPONSE, ATTACHED HERETO AS EXHIBIT "B "; <br />AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; <br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS. <br />NECESSARY TO EFFECTUATE THE TERMS OF THE. AGREEMENT; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach is in need of a qualified contractor for the <br />Atlantic Isles roadway and utility improvements; and <br />WHEREAS, this project includes construction of the design of roadway irnprovements, <br />construction of sanitary sewer collection system with gravity sewer lines, manholes, WASD Lift <br />station and force main, paving, grading, and drainage improvements, and. undergrounding of certain <br />utilities for the health, welfare and benefit of its citizens; and <br />WHEREAS, the City issued and advertised Bid No. 08- 06 -01, for Atlantic Isles Roadway <br />and Utility Improvements, for which thirteen (13) responses were received; kind <br />WHEREAS, staff has determined that the bid response from Tenex. Enterprises, attached <br />hereto as Exhibit "I3 ", is the lowest responsible responsive bid; and <br />WHEREAS, Calvin, Giordano and Associates, the City's Engineering Consultant on this <br />project, has recommended the bid award, based on a careful review of the line items and <br />consideration of the Contractor's reputation; and <br />WHEREAS, the City wishes to award Bid No. 08 -06 -01 to and enter into an agreement with <br />Tenex Enterprises to provide services on a unit price basis for the Atlantic Isles Roadway and Utility <br />Improvements, in an amount not to exceed Two Million Eight Hundred Mighty -Five Thousand Forty - <br />Eight Dollars ($2,885,048.00), attached hereto as Exhibit: "A ". <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Incorporation of Recitals.
