RESOLUTION NO. 2016- �S <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, RATIFYING THE "DECLARATION <br /> OF A LOCAL EMERGENCY" IMPOSED BY THE CITY MANAGER <br /> ON OCTOBER 5, 2016 AND THE "TERMINATION OF A LOCAL <br /> EMERGENCY" ISSUED-ON OCTOBER 7, 2016 DUE TO HURRICANE <br /> MATTHEW; AUTHORIZING THE CITY MANAGER TO DO ALL <br /> THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS <br /> RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the City of Sunny Isles Beach faced dangerous conditions of sufficient <br /> severity and magnitude to warrant coordinated local government action to prevent or alleviate the <br /> damage, loss, hardship or suffering threatened or caused thereby; and <br /> WHEREAS, County Manager Carlos A. Gimenez declared a State of Emergency for <br /> South Florida due to the threat of impending Hurricane Matthew; and <br /> WHEREAS, Governor Rick Scott declared a State of Emergency for all of Florida due to <br /> the threat of impending Hurricane Matthew; and <br /> WHEREAS, President Barack Obama issued an Emergency Declaration for the State of <br /> • Florida due to Hurricane Matthew; and <br /> WHEREAS, Hurricane Matthew caused a condition of peril of life and property <br /> • necessitating the proclamation of the existence of an emergency and in accordance with Chapter <br /> 29 of the City of Sunny Isles Beach Code, the City Manager declared a local emergency due to <br /> Hurricane; and <br /> WHEREAS, the emergency dangers and threats of Hurricane Matthew have passed, and <br /> the City Manager of the City of Sunny Isles Beach has terminated the State of a Local <br /> Emergency. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Confirmation of Declaration of a Local Emergency. The City Commission of the <br /> City of Sunny Isles Beach hereby ratifies the "Declaration of a Local Emergency" imposed by the <br /> City Manager on October 5, 2016, attached hereto as Exhibit "A". <br /> Section 2. Confirmation of Termination of the State of Local Emergency. The City <br /> Commission of the City of Sunny Isles Beach hereby ratifies the "Termination of a Local <br /> Emergency" issued by the City Manager on October 7, 2016, attached hereto as Exhibit "B", <br /> provided however this confirmation of termination shall not be construed as a limitation on the <br /> City Manager's authority to declare a state of emergency at any date subsequent to this <br /> resolution. <br /> R2016-Declaration&Termination Of Local Emerg(Hurricane Matthew).Doc Page 1 of 2 <br />
