ORDINANCE NO. 98-13 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, DESIGNATING THE CITY COMMISSION AS THE LOCAL PLANNING AGENCY FOR THE CITY, PROVIDING FOR TRANSMITTAL; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND EFFECTIVE DATE. WHEREAS, the City Commission, pursuant to Section 163.3174(1) Florida Statutes, wants to designate the City Commission of the City of Sunny Isles Beach, as the Local Planning Agency for the City, and; WHEREAS, the Local Planning Agency shall have the responsibility for the conduct of the Comprehensive Planning Program; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: SECTION 1. The Code of the City of Sunny Isles Beach, Florida, is hereby amended by adding a new article which shall ready as follows: ARTICLE . DESIGNATION OF LOCAL PLANNING AGENCY. Sec. 1. Designation of Local Planning Agency. Pursuant to and in accordance with Section 163.3174, the City Commission of the City of Sunny Isles Beach is hereby established as a Local Planning Agency for the City of Sunny Isles Beach. Sec.2. Duties and Responsibilities of Local Planning Agency. The Local Planning Agency in accordance with Section 163.317 4(4) Florida Statutes shall, (A) be responsible for the preparation ofthe Comprehensive Plan or Plan Amendment, including all decisions regarding adoption and amendment during the preparation of the Plan or Plan Amendment, the Local Planning Agency shall hold at least one public hearing, with public notice, on the proposed plan or plan amendment. The Local Planning Agency may designate any agency, committee, department, or person to prepare the Comprehensive Plan or Plant Amendment, but final recommendation of the adoption of such Plan or Plan Amendment shall be the responsibility of the Local Planning Agency. 0RD9S-13(F)
