<br />Nothing contained in this Ordinance shall prohibit the City from enforcing its Code by any <br />other means. The enforcement procedures outlined herein are cumulative to all others and <br />shall not be deemed to be prerequisites to filing suit for the enforcement of any section of <br />this Code. <br /> <br />Sec. 14. <br /> <br />Additional Enforcement Powers. <br /> <br />In addition to the powers and authority given to the Special Masters for the City pursuant to <br />this Ordinance, the City may, in its discretion, exercise any powers given to municipalities <br />or their special masters by Florida Statute, Chapter 162, as amended. <br /> <br />Sec. 15. <br /> <br />Schedule of Civil Penalties. <br /> <br />(A) The schedule of civil penalties, as may be amended from time to time, shall be the <br />same as set forth in Section 8CC-to of the Code of Miami-Dade County and is attached for <br />convenient reference. <br /> <br />(B) For violations of any section of this Code for which a specific penalty is not <br />prescribed in Section 17 a penalty shall be imposed which shall not be less than $25.00 nor <br />more than $250.00 per day for a first violation and shall not be less than $50.00 nor more <br />than $500.00 per day for a repeat violation. For the purposes of continuing violations, each <br />day shall constitute a separate violation. <br /> <br />Sec. 16. <br /> <br />Repeal of Conflict Provisions. <br /> <br />Except for Section 8CC-l 0 (Schedule of Civil Penalties) which shall remain in full force and <br />effect, the remainder of Chapter 8CC of the Miami-Dade County Code as made applicable <br />to the City by Article 8, Section 8.3 of the City Charter is hereby repealed. <br /> <br />Sec. 17. <br /> <br />Severability. <br /> <br />The provisions of this Ordinance are declared to be severable and if any section, sentence, <br />clause or phrase of this Ordinance shall for any reason be held up to be invalid or <br />unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Sec. 18. <br /> <br />Inclusion in the Code. <br /> <br />It is the intention of the Commission, and it is hereby ordained that the provisions of this <br />Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the <br />sections of this Ordinance may be renumbered or relettered to accomplish such intentions, <br />and that the word "Ordinance" shall be changed to "Section" or other appropriate word. <br /> <br />Sec. 19. Effective Date. <br />This Ordinance shall be effective ten days after adoption on second reading. <br /> <br />-11- <br />
