<br />Sec. 5. <br /> <br />Authority to Initiate Enforcement Proceedings. <br /> <br />Code Enforcement Officers shall have the authority to initiate code enforcement proceedings <br />and to issue Notices of civil violations as provided below. Special Masters shall not have <br />such authority. A Code Enforcement Officer shall not by such designation have powers of <br />arrest or subject the officer to the requirements of Sections 943.085-943.255, F.S. (1995). <br /> <br />Sec. 6. <br /> <br />Enforcement Procedures. <br /> <br />(A) A Code Enforcement Officer is authorized to issue a Notice of Violation to a person <br />when, based upon personal investigation, the officer has reason to believe that the Violator <br />has committed a civil infraction in violation of a duly enacted Ordinance and shall specify a <br />reasonable time period, not to exceed thirty (30) days, within which the Violator must correct <br />the violation. This determination shall be based on consideration offaimess; practicality; ease <br />of correction, ability to correct; severity of violation; nature, extent, and probability of danger <br />or damage to the public; degree of nuisance to neighbors and neighborhood; and other <br />relevant factors relating to the reasonableness of the time period prescribed. <br /> <br />(B) If a Code Enforcement Officer has reason to believe that the violation represents a <br />serious threat to the public health, safety or welfare or if the violation is an Uncorrectable <br />Violation as defined above, the correction period shall not be applicable and the Notice of <br />Violation may issue immediately. <br /> <br />Sec. 7. Contents and Service of the Notice of Violation. <br /> <br />(A) A Notice of Violation shall include, but not be limited to, the following: <br /> <br />(1) Date and time of issuance. <br /> <br />(2) Name of Code Enforcement Officer and department issuing the Notice. <br /> <br />(3) Name and address ofthe Violator. <br /> <br />(4) The section of the Code that has been violated. <br /> <br />(5) Brief description of the nature of the violation, including location, date and <br />time of violation. <br /> <br />(6) Amount of the civil penalty for which the Violator may be liable. <br /> <br />(7) Instructions and date for paying the civil penalty or for filing a request for an <br />administrative hearing before a Special Master to appeal the civil penalty. <br /> <br />-4- <br />
