<br />Section 5. Hold Harmless. <br /> <br /> <br />(a) Prior to the issuance of a certificate of compliance by the City Manager, the <br /> <br />applicant shall furnish to the City Manager a written statement, in form satisfactory to the <br /> <br /> <br />City Attorney, whereby the Distributor of the newsrack agrees to indemnify and hold <br /> <br /> <br />harmless the City, its officers, and employees, from any loss,liability, or damage, including <br /> <br /> <br />expenses and costs, for bodily or personal injury, and for property damage, including <br /> <br /> <br />expenses and costs, for bodily or personal injury, and for property damage sustained by any <br /> <br />person as a result of the installation, use, maintenance and/or removal of a newsrack within <br /> <br /> <br />the city. <br /> <br />Section 6. ~ <br /> <br /> <br />There shall be a one-time only certificate of compliance fee in the amount of fifty ($50.00) <br />dollars for each newspaper publisher plus ten ($10.00) dollars per newsrack. Failed inspections are <br />subject to a reinspection fee of five ($5.00) dollars. All of the above fees will be used to defray <br />administrative expenses relating to this Ordinance only. This fee is unrelated to any fee that might <br />be assessed by the City as a result of code enforcement violation described in Section 12 <br />hereinbelow. <br />Section 7. Appeals. <br />Any applicant who has been denied a certificate of compliance pursuant to the provisions <br />of this Ordinance may file an appeal with the City Commission by requesting in writing to the City <br />Manager appearance before the Commission to review such denial. The appeal shall be heard by <br />the Commission within thirty (30) days of the filing of the appeal or at the next regularly scheduled <br /> <br />agenda, whichever is sooner. <br /> <br />ncwonok ordinIIl<:c (t) <br /> <br />-6- <br />
