be available for public consumption at the planning, development and building department. Section 2. Changes in Plans and Specifications as may be required. It shall be the duty of the Building Official to require changes, if any, in any plans and/or specifications presented, as may be necessary to conform to the provisions of this and all Ordinances of the City of Sunny Isles Beach. The City Manager, or his designee, may also suggest or recommend such changes in plans and specifications as in his judgement may be requisite or appropriate to the maintenance of a high standard of construction, architecture, beauty and harmony. Section 3. Samples of Color and Painting and Awning Work. Which applicant for or holder of a permit authorizing exterior painting, coloring, awning work or erection of a canopy shall be required to submit to the City Manager, or his designee, for hislher approval, prior to the execution of such work, a sample of the color to be used in such work. The colors shall be approximate to, appropriate and harmonious with the palette of colors that will be available for public consumption in the Building, Planning and Zoning Department. Section 4. Fees for Examination of Plans and Specifications. For examination of such plans and specifications by the City Manager, or his designee, there shall be charged and collected by the City in addition to all other building permit fees with respect to the examination of material and color for the exterior walls, a fee of $10.00. Section 5. Severability. The provisions ofthis Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall, for any reason, be held invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 6. Re.peal of Conflicting Ordinances. All Ordinance of parts of Ordinance in conflict herewith be and the same are hereby repealed. Section 7. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-Iettered to accomplish such intentions and that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 7. Effective Date. This Ordinance shall take effect ten (10) days after its adoption at second reading. PASSED AND ADOPTED on first reading the 13th day of August, 1998.
