<br />ORDINANCE NO. 99- \v \ <br /> <br />AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AMENDING SECTION 33-84 "DEFINITIONS" TO <br />INCLUDE THE DEFINITION OF "WINDOW SIGNS"; AND <br />AMENDING SECTIONS 33-103, 33-105 AND 33-106 TO <br />INCLUDE THE TYPE OF WINDOW SIGN, THE SIZE OF A <br />WINDOW SIGN, THE NUMBER OF SIGNS PERMISSIBLE, <br />TO PROVIDE THAT ILLUMINATION IS PROHIBITED <br />EXCEPT FOR NEON SIGNS NOT EXCEEDING 50% OF <br />ALLOWABLE AREA; ENUMERATING SPECIAL <br />CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach by Section 8.3 of its City Charter has adopted <br />the Code of Miami-Dade County as its own Code of Regulations; and <br /> <br />WHEREAS, the City of Sunny Isles Beach, for the health, safety and welfare of its citizens, <br />desires to regulate window signs in its permissible zones and must therefore amend several sections <br />of Chapter 33 Zoning in order to accommodate regulations of window signs; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />1. Definitions. Section 33-84, Definitions is hereby amended to add: <br /> <br />"33-84 (y) Window Signs: Any sign, picture, symbol or a combination thereof, <br />designed to communicate information about an <br />activity, business, commodity, event, sale, or service, <br />that is placed either upon the window panes or glass <br />or inside a window, and is visible from the exterior of <br />the window or glass." <br /> <br />2. Amendment of Sections 33-103, 33-105 and 33-106. <br /> <br />Sections 33-103, 33-105 and 33-106 are hereby amended to include as follows in each <br />section: <br /> <br />Setbacks: <br />Illumination: <br /> <br />Window Sign <br />Ten percent (10%) of window pane or glass area <br />Only one (1) sign per 100 square feet of window pane or glass area, <br />type selected by applicant <br />Not applicable <br />No window sign shall be illuminated except that neon signs not <br /> <br />"Type of Sign: <br />Size of Sign: <br />Number of Signs: <br /> <br />Signs Amendment Ord. <br /> <br />-1- <br />
