<br />ORDINANCE NO. 2000- <13 <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AMENDING ORDINANCE NO. 99-74 <br />BY ADOPTING A REVISED FEE SCHEDULE, INCLUDING COSTS, <br />FOR ZONING HEARINGS AND CERTIFICATES OF USE, WHICH <br />REVISED FEE SCHEDULE IS ATTACHED HERETO AS EXHIBIT "A"'; <br />PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, on June 17, 1999, the City of Sunny Isles Beach adopted a fee schedule <br />which had been revised by Miami-Dade County and, at the recommendation of staff, was <br />subsequently adopted for the City by the Ordinance; and <br /> <br />WHEREAS, City staff now recommends a newly revised fee schedule for zoning <br />hearings and wishes to establish a fee schedule for certificates of use as well as administrative <br />charges for advertising and notices; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Adoption of Fee Schedule for Zoning Hearings. Certificate of Use. etc. Ordinance <br />No. 99-74 is hereby amended to include the revised zoning hearings and certificate of use fee <br />schedule attached hereto as Exhibit "A," which shall become effective for the City of Sunny Isles <br />Beach upon adoption after second reading. <br /> <br />Section 2. Costs Included. Included in the fee schedule is a percentage, which reflects the <br />costs of advertising and notices for zoning hearings and establishes a fixed fee for same. <br /> <br />Section 3. Repealer All ordinances or parts of ordinances in conflict herewith be and the <br />same are hereby repealed. <br /> <br />Section 4. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be <br />invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Section 5. Inclusion in the Code. It is the intention of the City Commission and it is hereby <br />ordained that the provisions of this Ordinance shall be included and incorporated into the Code <br />of Ordinances of the City of Sunny Isles Beach as an addition thereto and the sections of this <br />Ordinance may be renumbered to conformed to any uniformed numbering system. <br /> <br />Revised Zoning Hearing Fees Amending 099-74 <br />LMD:ch <br />4/27/00 -- 11 :07 AM <br /> <br />1 <br />
