ORDINANCE NO. 2001-.JJ..k AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, FURTHER AMENDING ORDINANCE 98-52 AMENDING SECTION 33-317 ENTITLED "LIMITATION ON ISSUANCE OF PERMITS," TO INCLUDE A SECTION WHICH REQUIRES COMPLIANCE WITH ZONING CODE AND ALL ZONING RESOLUTIONS ISSUED THEREUNDER BEFORE ANY PERMIT IS ISSUED; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, by Section 8.3 of the Charter of the City of Sunny Isles Beach, the City adopted the Code of Miami-Dade County as its own; and WHEREAS, Section 33-317, entitled "Limitation on Issuance of Permits" was amended by Ordinance 98-52 and this amendment which shall hereinafter be referred to as Section 33- 317A; and WHEREAS, the City of Sunny Isles Beach is now undertaking to develop a new land development code which shall be produced within the year, the City wishes to reinforce the following provisions; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: Section I Section 33-317B. Compliance with Zoning Code. Before any permit is issued all provisions of the zoning code of the City of Sunny Isles Beach, including any variance, special exception, new use, unusual use or special use which has been acted upon, whether administratively by staff, or, by decision of the City Commission, and any amendments thereto shall be complied with and the provisions of the South Florida Building Code shall not be construed to repeal, supercede or modify any part of the zoning code, decisions of staff or City Commission or amendments thereto. Section 2 Repealer. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 3 Severability. If any section, subsection, clause or provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected by such invalidity. Section 4 Inclusion in the Code. It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance be included and incorporated into the Code of Ordinances of the City of Sunny Isles Beach as an addition thereto and the sections of this Ordinance may be renumbered to conform to any uniformed numbering system.
