<br />... <br /> <br />" <br /> <br />ORDINANCE NO. 2001- ~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AMENDING ORDINANCE NO. 99-65 <br />PERTAINING TO "ELECTIONS," BY AMENDING SECTION 5, <br />"CANVASS OF ELECTION RETURNS, CERTIFICATE OF ELECTION' BY <br />REVISING THE COMPOSITION OF THE CANVASSING BOARD; <br />PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; PROVIDING <br />FOR SEVERABILITY; INCLUSION IN THE CODE; AND PROVIDING FOR <br />AN EFFECTIVE DATE <br /> <br />WHEREAS, Section 2.4 of the Municipal Charter of the City of Sunny Isles Beach, <br />provides that the procedures for qualifying as a candidate for the office of Mayor or City <br />Commissioner shall be prescribed by ordinance; and <br /> <br />WHEREAS, the City Commission of the City of Sunny Isles Beach adopted Ordinance <br />No. 99-65, pertaining to Elections; and <br /> <br />WHEREAS, the City Commission of the City of Sunny Isles Beach wishes to amend <br />Section 5, "Canvass of Election Returns, Certificate Of Election" of Ordinance No. 99-65, to <br />revise the composition of the Canvassing Board. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF <br />THE CITY OF SUNNY ISLES BEACH, FLORIDA: <br /> <br />Section 1. Section 5, "Canvass of Election Returns, Certificate of Election" of Ordinance <br />No. 99-65 is hereby amended to read as follows: <br />"All municipal elections which do not appear on the same ballot as a county election <br />shall be canvassed by a board comprised of the City Clerk, the City <br />Manager, and _ registered voter! to be designated by the City Commission, who shall <br />serve with the assistance ofthe Miami-Dade County Supervisor of Elections. The City Clerk <br />shall present a certification of election results to the City Commission at the first meeting of the <br />City Commission following an election. Canvassing of election returns shall be conducted <br />under applicable provisions of the Florida Statutes." <br /> <br />Section 2. Repeal of Conflicting Provisions. <br />All ordinances or parts of ordinances in conflict herewith be and the same are hereby <br />repealed. <br /> <br />02001- Amending 099-65 Elect.
