<br />ARTICLE VI. <br /> <br />VARIANCE PROCEDURES. <br /> <br />(llJAt The City Commission shall hear and decide appeals and requests for variances from the <br />requirements of this Ordinance. <br /> <br />ill ~ The Commission shall hear and decide appeals when it is alleged an error in any requirement, <br />decision or determination is made by the Building Official in enforcement or administration ofthis <br />Ordinance. <br /> <br />ill Anv person or entity aggrieved bv the decision of the City Commission may appeal such <br />decision to the Circuit Court. pursuant to the Florida Rules of Civil Procedure. <br /> <br />ill fGj Variances from this Ordinance may be issued for the repair or rehabilitation of historic <br />structures upon a determination that the proposed repair or rehabilitation will not preclude the <br />structure's continued designation as an "historic structure" and the variance is the minimum to <br />preserve the historic character and design of the structure. <br /> <br />ill ~ In passing upon such applications, the Commission shall consider all technical evaluations, <br />all relevant factors, all standards specified in other sections of this Ordinance, and the following: <br /> <br />@)JB The danger that materials may be swept onto other lands to the injury of <br />others; <br /> <br />Dll.~ The danger to life and property due to flooding or erosion damage; <br /> <br />{Y.~ The susceptibility of the proposed facility and its contents to flood damage <br />and the effect of such damage on the individual owner; <br /> <br />@'J4j The importance of the services provided by the proposed facility to the <br />community; <br /> <br />~ The necessity of a facility to a waterfront location, in the case of a <br />functionally dependent use; <br /> <br />ill f6j The availability of alternative locations, not subject to flooding or erosion <br />damage, for the proposed use; <br /> <br />(g) f7j The compatibility of the proposed use with existing and anticipated <br />development; <br /> <br />Qll f8j The relationship ofthe proposed use to a comprehensive plan and floodplain <br />management program for that area; <br /> <br />Flood Damage Prevention Ord. <br />Legislation/Ordinances/Attorney <br />10/2/01 --3:55 PM <br /> <br />20 <br />
