<br />ORDINANCE NO. 2004- ~,~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, <br />ESTABLISHING PROCEDURES FOR THE REVOCATION <br />OF ANY PERMIT ISSUED BY THE CITY; PROVIDING <br />FOR APPEAL; PROVIDING FOR SUSPENSION OF <br />PERMIT; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR INCLUSION IN THE CODE; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, it is necessary to establish procedures for the revocation of any permits <br />issued by the Departments of the City; and <br /> <br />WHEREAS, the City has the right to revoke any permit if the permittee failed to comply <br />with conditions for issuance of such permit; and <br /> <br />WHEREAS, the City Commission wishes to stream line the process of revocating <br />permits issued. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA AS FOLLOWS: <br /> <br />Section 1. Revocation of Permits. The City Manager or designee may revoke any permit <br />issued by the City for any of the following reasons: <br /> <br />a. Failure of the holder or operator to comply with the requirements of any ordinance or <br />code provisions relating to the permit being issued hereunder. <br /> <br />b. Failure of the holder or operator to comply with conditions or terms ofthe permit; or <br /> <br />c. Discovery by City officials that a permit was issued in error or on the basis of <br />incorrect information supplied to the city. <br /> <br />Section 2. Appeal. Any person or entity aggrieved by a finding, determination, notice, <br />order or action taken under the provisions of this Ordinance may appeal such action to the <br />City Manager by filing a written request to the City Clerk within fifteen (15) days of the <br />action. <br /> <br />Section 3. Suspension of Permit. Any permit subject to revocation is suspended pending its <br />revocation or an appeal relative thereto. <br /> <br />Section 4.
