ORDINANCE NO. 2004- ~,~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ESTABLISHING PROCEDURES FOR THE REVOCATION OF ANY PERMIT ISSUED BY THE CITY; PROVIDING FOR APPEAL; PROVIDING FOR SUSPENSION OF PERMIT; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it is necessary to establish procedures for the revocation of any permits issued by the Departments of the City; and WHEREAS, the City has the right to revoke any permit if the permittee failed to comply with conditions for issuance of such permit; and WHEREAS, the City Commission wishes to stream line the process of revocating permits issued. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: Section 1. Revocation of Permits. The City Manager or designee may revoke any permit issued by the City for any of the following reasons: a. Failure of the holder or operator to comply with the requirements of any ordinance or code provisions relating to the permit being issued hereunder. b. Failure of the holder or operator to comply with conditions or terms ofthe permit; or c. Discovery by City officials that a permit was issued in error or on the basis of incorrect information supplied to the city. Section 2. Appeal. Any person or entity aggrieved by a finding, determination, notice, order or action taken under the provisions of this Ordinance may appeal such action to the City Manager by filing a written request to the City Clerk within fifteen (15) days of the action. Section 3. Suspension of Permit. Any permit subject to revocation is suspended pending its revocation or an appeal relative thereto. Section 4.
