water craft or other marine equipment. A facility for short-term or long-term docking that is ancillary to other land uses is not a marina. (d) Walkvvav means a path designated for pedestrian use and separated from the through lanes for motor vehicles by space or barrier. Section 4. Marina Fence Required. It shall be the duty of marina owners and operators operating within the corporate limits of the City of Sunny Isles Beach to install and maintain a fence made of aluminum or other materials of similar quality and design to enclose and secure the perimeter and all entry points of all boat docks located within their respective marina. Barbed wire and chain link fences are prohibited. Section 5. Height Limit. The minimum permitted height for marina fences is five (5) feet. Section 6. Permit Required. A permit is required for the construction or erecting of all marina fences. All marina owners and operators shall apply for a permit to construct or erect a fence no later than sixty (60) days after the adoption date of this Ordinance. All requests for marina fences shall be submitted to the City Manager or designee, for review and approval, accompanied with a set of plans that identifies the site/location of the proposed fence and the quality and design of the materials to be used. Section 7. Penalties. Failure to comply with this ordinance shall subject marina owners and operators to the penalties prescribed in section 162.22 of the Florida Statutes, as well as Code Enforcement pursuant to Chapter 14 of the City's Code of Ordinances, providing for a maximum fine of $500 for each single violation and up to $500 per day for each continuing or repetitive violation. Section 8. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any patio Section 9. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this ordinance shall become and be made a pati of the code of the City of Sunny Isles Beach, Florida; and that the sections of this ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 10. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 11. Effective Date.
