<br />water craft or other marine equipment. A facility for short-term or long-term <br />docking that is ancillary to other land uses is not a marina. <br /> <br />(d) Walkvvav means a path designated for pedestrian use and separated from the <br />through lanes for motor vehicles by space or barrier. <br /> <br />Section 4. Marina Fence Required. It shall be the duty of marina owners and operators <br />operating within the corporate limits of the City of Sunny Isles Beach to install and maintain a <br />fence made of aluminum or other materials of similar quality and design to enclose and secure <br />the perimeter and all entry points of all boat docks located within their respective marina. Barbed <br />wire and chain link fences are prohibited. <br /> <br />Section 5. <br /> <br />Height Limit. The minimum permitted height for marina fences is five (5) feet. <br /> <br />Section 6. Permit Required. A permit is required for the construction or erecting of all <br />marina fences. All marina owners and operators shall apply for a permit to construct or erect a <br />fence no later than sixty (60) days after the adoption date of this Ordinance. All requests for <br />marina fences shall be submitted to the City Manager or designee, for review and approval, <br />accompanied with a set of plans that identifies the site/location of the proposed fence and the <br />quality and design of the materials to be used. <br /> <br />Section 7. Penalties. Failure to comply with this ordinance shall subject marina owners and <br />operators to the penalties prescribed in section 162.22 of the Florida Statutes, as well as Code <br />Enforcement pursuant to Chapter 14 of the City's Code of Ordinances, providing for a <br />maximum fine of $500 for each single violation and up to $500 per day for each continuing or <br />repetitive violation. <br /> <br />Section 8. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be <br />invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any patio <br /> <br />Section 9. Inclusion in the Code. It is the intention of the Commission, and it is hereby <br />ordained, that the provisions of this ordinance shall become and be made a pati of the code of the <br />City of Sunny Isles Beach, Florida; and that the sections of this ordinance may be renumbered or <br />relettered to accomplish such intentions; and that the word "ordinance" shall be changed to <br />"section" or other appropriate word, as required. <br /> <br />Section 10. Repealer. All ordinances or part of ordinances in conflict herewith be and the <br />same are hereby repealed. <br /> <br />Section 11. Effective Date.
