<br />ORDINANCE NO. 2006- 'A. 5 B <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br />SECTIONS 233-3 AND 233-5 OF THE CODE OF THE CITY <br />OF SUNNY ISLES BEACH TO INCREASE THE <br />APPLICATION FEE FOR SPECIAL EVENTS PERMITS; <br />CREATING AN APPLICA TION FEE SCHEDULE FOR <br />SPECIAL EVENTS PERMITS; REPEALING SECTION 233- <br />5 IN ITS ENTIRETY; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR REPEALER; PROVIDING FOR <br />INCLUSION IN THE CODE; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach currently provides for a permit application <br />fee for special events, but no outdoor special events; and <br /> <br />WHEREAS, outdoor special events are held on a regular basis in the City and impacts <br />the City's resources; and <br /> <br />WHEREAS, in order to maintain the same level of services and protect the health and <br />welfare of its residents, the City wishes to amend Ordinance No. 2004-209 by establishing <br />criteria for hosting of outdoor special events in the City. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Amendment. Section 233-3 of the Sunny Isles Beach Code of Ordinances is <br />amended as follows: <br /> <br />A. The City Manager or designee may impose such fees as they determine appropriate <br />considering the impact of the special event on the City facilities and services, including <br />without limitation, user fees for particular City properties, rates for exclusive use of <br />public property, and concession agreements for paid admissions, and sale of food, <br />beverage and merchandise on public property. The City Manager may, ffi at his <br />discretion, reduce or waive the submission periods, or fees for events by not-for-profit <br />corporations, for a particular event when such waiver is found to be in the best interest of <br />the City. <br /> <br />B. An application fec of fOliy ($10.00) dollars shall be submitted \vith a special event permit <br />application.
